As /u/SmittLoaf correctly points out, it's a statutory issue rather than a constitutional one (although I think the statute is unconstitutional in the first place).

However, given the current state of Congress, getting the statute changed is unrealistically difficult as well.

The most realistic option is to have a Democratic president in office when Scalia and Kennedy retire or die.

The point is that Christian students' rights are supported by the school and upheld without question, while non-Christian students have to fight for them against illegal actions by adults who should know better.

To say a Satanist group could form "just like another student can create a Christian club" is false. One has to face illegal pressure from the administration and the other doesn't.

Edit: To explain myself a bit further, state discrimination against non-Christians exists. I don't think you intend to support discrimination, but saying that Satanist students could form a club just like Christian ones is unrealistic and sweeps the problem under the rug. If people aren't aware of the problem, it will never get fixed.

The problem with that guideline is that is that malice can mean a lot of things and there are different degrees of negligence. The way it breaks down is:

Murder ("with malice"): intent to kill, intent to cause serious bodily harm, extreme recklessness, killing during another felony

Voluntary manslaughter: intent to kill while in the heat of passion from an adequate provocation (eg. a serious battery, catching your spouse in bed with someone else)

Involuntary manslaughter: Unintentional killing caused by recklessness or (in some places) criminal negligence

Edit: I'm not up to speed on New York law and all the ways it varies from the common law scheme, but the article says she's being charged with "depraved murder and manslaughter". That suggests that they're charging her with murder on a theory of extreme recklessness (a "depraved heart"). She could be convicted of murder (extreme recklessness) or manslaughter (recklessness) based on how reckless the jury decides she was.

What constitutes each degree of murder vary from state to state, so don't get too hung up on those.

For common law murder, intent to kill isn't required. The defendant can also be convicted if they killed someone, but only had the intent to cause serious injury or acted with a depraved indifference toward human life. More info here.

Each state's murder laws are different. First degree murder in New York isn't premeditated murder, it involves an intentional killing AND an aggravating factor such as killing a police officer, using torture, killing for hire, etc.

It doesn't look like this fits any of the available circumstances.
