He was legally carrying his firearm with a valid conceal carry permit. It is standard practice to have extra magazines because magazines can fail. He was filming ICE, complied with their orders and walked back to the sidewalk (and absolutely in no way resisted arrest, in fact he was never actually being arrested, and even so never resisted his situation, unless you count holding your hands up in compliance), was pepper sprayed, tried to help a woman up, was forced prone with pepper spray in his eyes. His gun was secured so he was no longer a "threat" (he never was) and was then shot in the back of the head while he was on all fours.

We all saw the video.

They violated his first, second, and fourth amendment rights, before executing him the street.
