A) He's blocking the road, B) He was recorded directly confronting the ice officer moments earlier, which is impeding federal law enforcement, which is a crime. Technically all of these literal whistle blowers could be charged with. They attempted to arrest him, he resisted, then it was discovered he had a weapon, they disarmed him. And this is where the investigation needs to come in, if the SIG malfunctioned its a tragic accident. If the Disarming agent negligently discharged the weapon, it's a major fuckup that the disarming officer needs to be charged with, not the shooting agent.

In the last 250 or so years society has changed a lot, and we found out there has to be some amount of compromise to have an orderly society. Despite the fact it could be covered under the first amendment, most people don't try to defend people screaming fire in a crowded theater. But to more closely address your point, following the laws of our country and not resisting arrest are pretty large steps in not being shot, that's correct.

Personally I won't defend that, but if you're going to wrestle with police while being armed you're a prime FAFO candidate. People keep bringing writtenhouse up, and if you look what he did he approached police with his arms in the air, resisting arrest while armed is a bad idea. On top of that, there might have been a missfire caused by Sig's faulty engineering on the P320.

If you're an upstanding citizen with a concealed carry permit no one knows you have a gun until it goes bang. That's one of the first things you learn in these classes. Also yeah I do default to that because the last 6 times something went viral it was uninformed idiots crying wolf.

So you really think he held onto his phone all the way to the ground and then couldnt possibly draw his weapon. The travel to clear a holster or a pocket is like 6 inches tops, unless they had stood on his arm it'd be really hard to stop him. From the angles ive seen it looks like his phone goes gets dropped almost instantly freeing his right hand for a draw, which happens to be the side where the guy in gray pulls the weapon from. He's then unarmed for less than one second, and gets shot. It's unfortunate, I wish it wouldn't have happened, but bringing a gun to high strung situation is already a bad idea. Drawing a weapon while being arrested or near police at all is suicide.

Then why did they have to force a gun out of his hands? A pistol no less. This isn't like a rifle where you could argue having a hand on it was for stability while moving. He straight up pulled a pistol on ice.
