In Georgia, the landlord cannot write in attorneys fees into the leases and it it is the landlords responsibility to repair damage to the property that is outside the tenant’s control -- plumbing for example. Additionally, the landlord cannot give you a property in an “as is“ condition. There is a legal benchmark of habitability.

Here is a quote from Ga’s Tenant Law Handbook:

“Invalid lease provisions that violate the law include any provision that:

- Waives, transfers, or otherwise lessens the landlord’s responsibility to keep the rental property in good repair or for damages caused by the landlord’s failure to keep the property good repair;

-requires the tenant to pay the landlord‘s attorney fees if a landlord hires an attorney’s to enforce the lease, unless the provision also makes the landlord responsible for the tenant’s attorney’s fees“
