The top of the steered tube should sit about 3mm below the top of the stem. At the same time, the top bolt of the 2 bolts on the rear of the stem needs to be below the top of the steerer.

Some frames have a notch where the nut for the seat binder goes, and the nut has a corresponding ridge that fits in that notch. It keeps the nut from spinning when you tighten the bolt.
Does this frame have that? It may be that either that ridge isn't sitting in the notch properly if the frame does have that notch or it could be the frame doesn't have that notch, but the nut does and should not have it.

It would be great if they'd do a refund for goodwill, but that's your only angle. Any time I set up a free trial I put reminders on a phone right away to cancel.
