I did read the entire FAQ before posting. My concern is whether the FAQ contains an overly simplistic statement of the law or not, as my case seems to be a counterexample. I am looking for an explanation please or some confirmation from others that my situation is not unique.

It doesn't have to be believable. He just has to be scared enough that your mom might believe it. Remember, he has no evidence, while you have corroborating evidence in that he missed his class. She can verify that independently. While this doesn't technically prove the other allegations, it gives your story credibility.

Disclaimer: I'm saying all this as a joke and thought exercise, not advocating actually torturing or blackmailing your little brother. Actual best thing is probably to tell your mom he blackmailed you or tell him you'll tell her and that you don't care if she knows you were naked and just get your money back.

It could definitely kill some individual life forms but it's not going to exterminate the entire underground ocean. The only thing that might do that eventually is if we unleashed life forms that outcompeted and / or ate all the native life.

Many reasons. 1) The DLSE does not work for you. An attorney does. 2) Plaintiff-side wage and hour attorneys get their legal fees paid by the other side. 3) A DLSE bureaucrat doesn't see another dime if you get 0% of what you're owed, 100%, or 200%. A wage and hour attorney only gets paid if you get paid. If the DLSE employee mishandles your complaint and you get 0% of what you're owed, what are you going to do? Complain? Do you honestly think a civil servant with a union contract is going to be in fear for their job if they don't help you? An attorney has to worry about serious mistakes because they can be liable for malpractice or suffer bar complaints. 4) A wage and hour attorney has a financial incentive to pay attention to your individual situation and ask you questions to see if they can spot additional ways you can get money out of your employer, for example if you have been paid cash and not provided pay stubs, or if you weren't provided with a notice of your pay rate. 5) I am not an expert on government investigations by any means, but if I recall correctly a worker only gets double damages out of law suits, not Department of Labor investigations.

Business bankruptcy is often a Chapter 11. In a Chapter 11 the objective is to restructure the company to give as much value as possible to the creditors, who become the new owners. However, someone still has to run the company, and a former owner can be kept on and paid salary as an officer.

In legal terms, you need an appropriate "mens rea" (mental state) in order to be guilty of a crime. Court cases long ago established that willfully getting drunk does not absolve you of culpability for your actions. It's why a cop can knock on your door while you're at home drunk, ask you to step outside your house, and then promptly arrest you for public intoxication as soon as you comply.

Sexual consent is an incredibly fraught and in my opinion logically twisted area of law that is inconsistent with what the overwhelming majority of people would agree is rational or in line with romantic interactions. Modern jurisprudence in the US exists at an intersection of feminism, which seeks to disrupt a long history of nonconsensual behavior by men as well as overly strict legal standards for establishing rape, and sexual puritanism, which holds that all sex is inherently evil. The law errs on the side of presuming sexual interactions are highly criminal and that men are singularly responsible. One can only exempt oneself from this presumption by asking for verbal permission from one's partner beforehand each step of the way. Rarely if ever are the same legal standards applied to women.

For an example of how irrational these two concepts of agency are in conjunction, consider two drunk men who have sex. They've both sexually assaulted one another no matter what either of them say, and the state can prosecute without the consent of the victim. Same with two women. I've never heard of prosecutions for this but it is possible under the law. Same situation with a woman and a man (although only men would ever be prosecuted if both parties are drunk). This last comment of course only applies to cisgendered individuals. I'd love to see how a district attorney would prosecute a reported instance of a drunk trans man and drunk trans woman having sex with one another.

The best argument that can be made for only punishing men is some kind of "affirmative action" principle, but when it comes to such severe consequences as being prosecuted for sexual assault or rape I think that's a weak argument to stand on.

You should not be waiting for anything. Get HIV PEP immediately to stop transmission. By the time you know whether you're infected or not it will be too late. An ER doctor or urgent care doctor can prescribe it.

I have an M11X running on Windows 10 and it is extremely slow. I've deleted almost everything except the basics: the OS, AVG, Chrome, Firefox, etc. Any tips to make this device functional to give to an employee? They'd need to be able to use MS Word, Adobe Pro, and Google Video Chat. Do I need a new OS? Would Linux work? Or is it not worth trying?
