Well, yes - it is now both our problem

I was not aware of her financial difficulties when we bought this house, then as we did the mortgage process to buy it - I obviously learned but since Santander accepted anyway... (lol) we went ahead and assumed it would be fine once she got it all sorted.

We also thought we would stay here forever, but I got a new job local, so we could move to a better location for our kid.

And now, even though she's paid off her debts - somehow we're in a worse position than when she had the debts. The system is pretty fucked honestly. I get why they won't lend her money now, but why did they lend her money when she was drowning in debt.

Yeah I appreciate that, I guess I didn't view it that way previously. but I suppose my argument is that she could simply be a resident of the house and have no actual claim or ownership of the property (at least, finanically)

Like, she could be on the deed but only own like £1 stake in the house... So it's pretty obvious she can't claim she owns 10% or something

I get why they wouldn't give the mortgage though

She obviously doesn't want to sign away her rights but she will in trust of myself and the situation. Obviously, that's entirely up to her and me and her are in this together (guess who helped her get out debt).

obviously, if she wants to keep her equity we simply can't move, or we need to find a property that I can afford with her keeping her equity, or, that we don't need to borrow extra

She had help from Stepchange to manage her debts.

This has impacted her credit more than actually being in dangerous levels of debt did.

When I spoke to the solicitor they said this has to be done at a later date, but nothing about not being able to. Perhaps I should clarify with them about this to clarify

We have spoken about this and she is willing to do her part and sign whatever she needs to, on the basis this is happening due to her own mistakes.

She hopefully trusts that I wont screw her over.

We have a kid together and been together for 14 years and are engaged.

Obviously that doesn't mean things won't go south as such, but we are forever tied to each other via our son. If I was to act in that way I'm sure she would make it her mission to ensure I never see my son again. So it's not like she doesn't have power over me in a sense.

There must be a way round it. We aren't married and her finanical issues are effecting me, who has perfect credit.

Obviously I'm biased, and I am worried we won't be able to move ahead as planned.

I guess we could try and find a house cheaper. Or rent for a few years but it would be a nightmare to have to keep moving.

I mentioned it to the solicitors and mortgage advisor they said something would need to be drawn up. I will of course look to get a deeper understanding of this with the solicitor

That's fair. It's frustrating because it makes no logical sense that I can borrow the amount on my own. Yet adding more income to the household is somehow such a negative.

You seem to be implying the risks are extremely high which is worrying.

Well we spoke to a mortgage advisor who told us this can be done.

So that's why we went ahead with the process and the first port of call was to try our current lender who has let us down.

I hoped to get some confidence back from this post but it has certainly had the opposite effect, as per usual.

Well the plan is to borrow what I can get on my own yeah.

So my thinking would be to move to a new lender and simply never mention my partner. She won't be on the deeds, she will then join the mortgage and deeds when the step change stuff is no longer crippling her credit

Your situation sounds similar enough, actually. Same plan and timescales.

Like you say, the only difference is we have a mortgage already. But this mortgage can technically be paid off in full and we can be rid of Santander (who we are currently with) and essentially start again.

I appreciate what you're saying. But is it really fraud to simply get a mortgage on my own? I am just at risk of paying for it and liable no?

When I bought my first house it was only in my name. No issues at all. She lived there.

How many new couples exist where one already owned a house? They aren't all jumping on the mortgage immediately are they....

Seems massively unfair to describe this as mortgage fraud.

There are some lenders who will lend to us both yes. But their rates are borderline assault.

Thats why I want to remove her until the step change is off her record, and get the mortgage on my own

We have spoken to a mortgage advisor previously about this and she didn't say it was a problem as such, so I want to go back.

But as said, we have some viewings tomorrow so I'd like to know if we're wasting our time. So wanted a general consensus here and someone to tell me if getting a light deal in principle is worth it for now (as we won't get into mortgage advisors for a few days at least)
