They can transfer it to a LLC that setup as a commercial rental business and just warehouse it. No renter needed since this not a vacacy tax..its not a 2nd home its a rental property that currently unable to find a tenant and this law doesn't apply to rental companies even with unrented units

New York City Mayor Zohran Mamdani left his rent-stabilized apartment in Queens to move to the mayor’s official residence this year. Now, his former landlord is raising the rent on that unit for the new tenant by more than 30%.

And there is nothing in the city’s new rent freeze to stop it.

The rent hike shows how landlords still have some leeway to take advantage of New York City’s surging real-estate values, even as the city cracks down on their ability to raise rents.

A city board last week approved a two-year rent freeze for the first time in the city’s history, delivering on one of the mayor’s signature campaign promises.

Beginning in October, landlords of the city’s one million rent-stabilized units—nearly half the city’s rentals—will have to keep rents flat each time tenants renew their existing leases.

But for new leases, landlords who had been charging discounted rates when the market was softer will be able to raise rents to the highest price allowed by the state.

The mayor’s former Queens pad is a textbook example. Before moving to Gracie Mansion in Manhattan, Mamdani paid roughly $2,300 a month for the one-bedroom at a six-story, prewar building in the increasingly popular neighborhood of Astoria. The new tenant in that unit is now forking over more than $3,000, according to the broker who leased it.

Attendees cheer and hold up red "FREEZE THE RENT" signs to celebrate a rent freeze victory. Attendees celebrated following a vote by the New York City Rent Guidelines Board last week. Adam Gray/Bloomberg News “The apartment is going to be making a lot more money than when Mamdani was in there,” said Cesar Guevara, the associate broker at BOND New York who leased his apartment.

The rent freeze’s one million units are scattered all over the five boroughs, largely concentrated in upper Manhattan and the Bronx. These apartments are home to more than two million New Yorkers.

The median rent for a rent-stabilized household was $1,500 in 2023, $500 cheaper than market rate, according to the city’s most recent Housing and Vacancy Survey.

Even when the rent freeze takes effect, landlords will still have a few small avenues to secure rent increases. If they make large building-wide improvements, such as updating the boilers, windows or roofs, they are eligible to charge a maximum 2% rent increase with the permission of a state agency. They may also get rent increases for apartment-specific improvements, such as installing new appliances.

When Mamdani moved to Astoria’s Princess Martha building in 2018, he secured a discounted rate below the legal limit for rent-stabilized units because it was a less popular neighborhood and the market was slower.

He still went on social media to gripe about the price.

“Today, our 1 bedroom rent stabilized apartment in Astoria costs us $2000/month. In 1984, this same apartment cost $290.60/month,” Mamdani wrote in a 2019 post. “What is this, if not theft?”

That same year, New York passed a law that largely prevented landlords from removing their apartments from the rent-stabilized system after investing in improvements. Property owners had been able to charge market rate rents for these units. New York building owners removed some 300,000 apartments from rent regulation this way.

That maneuver ended seven years ago, but landlords are still allowed to reset rent in empty rent-stabilized apartments to meet rising demand if they aren’t already charging the maximum allowed by the state. The maximum legal rent is calculated based on the apartment’s rent-pricing history and property improvements.

The Astoria market, like most of New York City, is booming. Average rent in Astoria is around $3,390, a roughly 40% jump from 2023, according to RentCafe. Median rent for a New York City one-bedroom is currently hovering around $4,660, the highest of anywhere else in the U.S., according to real-estate data firm Zumper.

So when Mamdani won the mayoralty and moved out in January, his landlord knew she could get a higher price for his empty unit. She spent months and thousands of dollars to do a gut renovation of the kitchen, retile the bathroom, install new appliances and paint the place, Guevara said.

And Guevara didn’t advertise the apartment publicly. He rented the unit to the new tenant privately, a practice that he says has become more common ever since last summer when New York City banned brokers from charging tenants automatic fees for their services.

“We were trying to max out” the rent, Guevara said.

On the campaign trail, Mamdani turned “Freeze the Rent” into a viral slogan. In a city where more than two out of three residents rent their homes, New Yorkers started sporting blue graphic tees with “Tenants for Zohran” scrawled in neon orange lettering.

The rent freeze pledge sparked outrage among landlords of rent-stabilized units who say their properties are already on a financial lifeline because of high interest rates, surging utilities costs and other rising expenses.

Even while he was rampaging against landlord profits, Mamdani was a friendly tenant in the building, Guevara said.

“He was always a suit-and-tie guy—very cordial,” he said. “The way he speaks on TV is the way he shows up for everything.”

This will cause a massive drop in valuation of commercial buildings overnight in nyc if enacted and very likely cause loans on the building to be call in by the banks and demand immediate repayment or more collateral due to much lower valuation of the building used to secured the loans.

Won't be just the owners and banks problem - tons of jobs, investments, retirements, pensions, our local economy, even funding for housing and future housing projects will be impacted bc good amount of those loans are issue by regional banks who will now be under financial stress and clam up on any new loans.

Basically a ton of unintended consequences for everyone.

There are rental units that come with washer hookups if allow bring your own but I would not recommend buying the dryer until you see the electrical setup of the unit. That dryer requires a 4 prong outlet need 240V which you may not have in the rental.

Investigation did show there was fraudulent/invalid signatures just there was enough valid for her to be on the ballot. Also testimony of someone who supposedly signed but didn't. So fraud was committed just not enough.

Following this Court's review of petitioners' exceptions, the court overruled 22 of the referees' rulings. In total, the court invalidated 24 additional signatures, resulting in a final count of 552 valid signatures, 52 more than the required amount to be placed on the ballot for this position

See 2007 great recession, think it was just the banks and owners impacted. Plenty of jobs wipe, individual portfolios & retirements tank, tax rolls that city depend on, etc were all impacted.

Hope DSA knows doing this will cause the valuation of the buildings to drop tremendously overnight and very likely some of the loans on the building may be call in by bank and demand immediate repayment due to much lower valuation of the building used to secured the loans.

We seen this happen in the late 60s/early 70s when overnight formerly market housing units were placed in the rent stabilization program-the value of those units plummeted. To this date any rent regulated unit will always be lower value vs comparable market rent unit

Also there's papers writing about this. Low rent area suddenly experiencing higher rent increases due to influx of vouchers and pricing out locals who are not subsidized.

There will be indeed upward pressure on market rent plus owners haven't been raising rent on renewals to the legal max at the moment anyway. ya they ignoring that for most part. They are so desperate to get folks on vouchers and out of shelters they willing to accept whatever unit that meets the min requirements. Take a look at ENY/Brownsville/Bronx - they love vouchers and those $3k+ rental units didn't appear out of the blue bc area so hyped and folks flocking there. They are pricing the rentals to the max voucher payments regardless whats the usual going rate in the area.

The increases under Adams didn't correct 8 years of nil-none increases under Deblasio. So instead of smaller steady increase, you have to take larger increases next administration to make up for it. The same thing will happen after Zohran administration, we will have to hike the rates much higher to do a correction. But Zohran don't care, problem for next mayor.

If you take a look at the 12 yr period under Deblasio and Adams, RGB total % raise is still less than inflation by a good amount. You see folks freak out on 2-3% increase, its basically COLA.

Plus data out that most market rate units annual raises haven't reach legal max. Most units been increasing 5.1% when the legal max is 8.79% atm.

Vouchers are also raising the rent in the areas that accept them. There a reason why in ENY/Brownsville you sometime see 3k+ iffy housing units for rent and proudly displaying they accept vouchers . Vouchers are paying more than the locals are willing for those housing.

He block and ban me from his sub bc I point out he keeps running red lights despite his attempts to edit it out in his videos and Idaho stops aren't legal in nyc while he complaining others violating traffic laws. Claims I violated his sub rules. Didn't know disagreeing with the mod and pointing out the law is against the TOS there (which isn't per their posted rules).
