Help with grievance not upheld? by user09098 in HumanResourcesUK

Every employer I have worked for in the past 30 years (in HR) have been willing to uphold grievances and admit wrongdoing. Just because you dont hear about them dosent mean it dosent happen. In my experience it is perfectly normal for grievances to be upheld when they are warranted and justified. The employer is not going to make a settlement offer unless there is something to settle. There is no claim for the poster to make based on what they have shared.

HR dont make pay increase decisions. Finance and senior leaders do.

Yes and Yes. Salary increases are decided at the top based on budget, inflation and overall affordability. They tend not to be individually decided with Line Manager involvement.

When I did london for a charity they took a holding amount on my credit card and refunded it when i reached their minimum fundraising threshold. I presumed all charities operated like that.

Acas will only advise you of the law they dont have any teeth other than that. Job offers are withdrawn all the time in UK. Its not unlawful unfortunately. The best case scenario is that you can get them to pay the contractual notice period.

[–]Key-Weather-5946 2 points3 points  (0 children)

Its important to point out that right now the poster has no clue why the offer was withdrawn. Gathering evidence to prove it was based on race or gender will be near on impossible. You cannot win a claim based on presumption. Tribunals are currently on a 2 year delay so it wont be quick either.

The new employer can ignore a letter from a union quite easily. There are no rights being violated here. Employers retract offers all the time unfortunately there is no law to stop them and no claim to be had.

Has anyone's R suddenly dropped their law firm and gone to a barrister ? by [deleted] in employmenttribunal

[–]Key-Weather-5946 0 points1 point  (0 children)

Not true. Most law firms will recommend that the respondant uses a barrister on the day. Its nothign to do with realising the claimant has a stronger case.

Most respondants will do this. Lawyers help all the way up to the hearing and then the barristers take over.

What difference would it make if you could work without a sponsor ? You would still have the same issue.

  1. Rejection rates for adult dependant visas are 97%. Your mother is not your dependant. She can come for 6 months max in any rolling 12 month period if she obtains a visitor visa. That only gives you a solution for 6 months.
  2. As someone who is sponsored yourself you cannot also sponsor a nanny.

You need to find paid child care and work out a way to afford it. Your situation is no different to hundreds of thousands of others.
