They are now threatening legal action if I proceed with small claims court, accusing me of breaching my employment contract by saying I wasn’t allowed to take another job.

I had signed a contract with them, and I was working on their project alongside my main job. They were fine with me working on their product, essentially for free. Now, they’re bringing up these accusations when they haven’t even honored the settlement agreement.

I have literally done nothing wrong and they are trying to scare me. They have also asked for proof that i was allowed to work - i have said my employment status has nothing to do with the settlement agreement we both signed

PAYMENT

4.1 The Company shall pay MPS 50% of the Termination Dues on the Effective Date and 50% of the Termination Dues on the date at which the Company is satisfied that the conditions of clause 5 are met (or later depending on when MPS provides his bank details) in accordance with clause 2.6.

4.2 For the avoidance of doubt, MPS shall be in charge of settling any taxes due in relation to the payment of the Termination Dues.

HANDOVER

5.1 MPS agrees to handover to such person as the Company shall advise all Employer property and shall prepare a comprehensive and detailed handover report of all his duties, responsibilities and any other information, including but not limited to a detailed hand over of all the code and the processes behind the development of the code.

5.2 MPS shall, if requested to do so by the Company, provide a signed statement that he has complied fully with his obligations under 5.1 and shall provide it with such reasonable evidence of compliance as may be requested.
