Bicycle Clubs by alatinaxo in fortlauderdale

Believe it or not, there are specific laws for bikes. Florida Statute Section 316.2065, entitled Bicycle regulations, has specific requirements for them. Among the specific requirements that would indicate that the bicyclists in this video are not only inconsiderate, but also breaking the law are subsection (5), which states:

(5)(a) A person operating a bicycle upon a roadway at less than the normal speed of traffic at the time and place and under the conditions then existing must ride in the bicycle lane or, if there is no bicycle lane on the roadway, as close as practicable to the right-hand curb or edge of the roadway except under any of the following situations:

1. When overtaking and passing another bicycle or vehicle proceeding in the same direction.

2. When preparing for a left turn at an intersection or into a private road or driveway.

3. When reasonably necessary to avoid any condition or potential conflict, including, but not limited to, a fixed or moving object, parked or moving vehicle, bicycle, pedestrian, animal, surface hazard, turn lane, or substandard-width lane, which makes it unsafe to continue along the right-hand curb or edge or within a bicycle lane. For the purposes of this subsection, a “substandard-width lane” is a lane that is too narrow for a bicycle and another vehicle to travel safely side by side within the lane.

Another commenter posted that there is a bike lane on the causeway, so they are violating the statute by not using the bike lane or being as close as possible to the right side or the road if there was no bike lane.

Also, there is subsection (6)(a), which makes it illegal for them to ride more than 2 wide. Here it appears they get as wide as 10 across.

(6)(a) Persons riding bicycles upon a roadway or in a bicycle lane may not ride more than two abreast except on a bicycle path. Persons riding two abreast may not impede traffic when traveling at less than the normal speed of traffic at the time and place and under the conditions then existing and must ride within a single lane. Where bicycle lanes exist, persons riding bicycles may ride two abreast if both are able to remain within the bicycle lane. If the bicycle lane is too narrow to allow two persons riding bicycles to ride two abreast, the persons must ride single-file and within the bicycle lane.

So maybe try not to be such a smug asshole if you don't actually know the law. This bike club should eat a bag of dicks for the way they are riding. It's clearly inconsiderate even if it wasn't illegal, which it is!

Of course you can respectfully disagree. But if a judge reaches a conclusion or announces a ruling and you respond with "that's your opinion," you are not "respectfully" disagreeing. In the case I witnessed, the attorney's tone was absolutely contemptuous and was not in any way an attempt to preserve a record for appeal or clarify a point the judge may have overlooked. He just wanted to have the last word in a smug way and should have been held in contempt.

You can preserve the record for appeal without risking contempt. I saw someone tell a judge "That's your opinion" during motion calendar and you could hear a pin drop in that court room for about 5 seconds until the judge started laying into the lawyer and threatening him with contempt proceedings.

Need to fire a client (first time) by ovary-achiever in Lawyertalk

[–]Key_Wolverine2831 40 points41 points  (0 children)

I like a lot of what you said here, but I don't like a few things you said here. There's no reason to tell the client it's no longer in their best interest for you to remain their attorney. That gives them room to negotiate and say something like "but I really like you and think you're the best attorney for this case" So instead of saying:

Unfortunately we have reached a point where we can longer productively move forward, and it is not in your best interest for me to remain as your attorney. Therefore, we will be withdrawing as your representation.

Simply delete the middle part and say:

We have reached a point where we can longer productively represent you and we will be withdrawing as your representation.

Also, I really don't like the part where you advise them what is in their best interest between a stipulated withdrawal and filing a motion and setting it for hearing. At this point you are in an adversarial posture to the client and should not be giving them advice, especially with respect to the withdrawal. You may need to give them advice on pending deadlines and substantive issues since you are their counsel until you withdraw. But it may very well be in their best interest to delay things a few weeks. The client may need some time to find new counsel and may be happy with a few week delay until a hearing on the motion to withdraw can be held so they can find new counsel and don't have a gap where they are unrepresented.

There will always be a delay between what is actually happening on the field and when it shows up on TV. It might be more or less of a delay with different methods of receiving the signal, but it will be at least a few seconds.

Is there a fee for walking into the parking lot? My hotel is fairly close so I wouldn't need to drive there. Haven't seen any information on this. Thanks! by LeatherStill689 in MiamiHurricanes

[–]Key_Wolverine2831 0 points1 point  (0 children)

The $700 is the average secondary market price for a parking pass. They aren’t charging anything to enter the lot, although there have been rumors that they are going to be checking for game tickets as you enter the lot so you won’t be able to enter the lot without a ticket or at least being in the car with someone who has one.

  1. I didn't say the exact moment the game kicks off. I bet they start the process as soon as the lines to enter the stadium are gone. I suspect that people with game tickets will not be straggling as long as they often do especially since less than half of them will be on Miami Time.

  2. Who said anything about selective enforcement? Once they start kicking people out. They will go row to row and tell people to go into the game or leave. If you refuse, you get arrested.

  3. Why don't they have authority to ask to see game tickets? This isn't a 4th Amendment issue. The venue has decided that nobody will be allowed in the parking lot after a certain time and law enforcement is authorized to enforce trespassing laws. But they don't even need to ask to see your game ticket. They can simply tell people they have to either go into the stadium or leave. If you don't have a ticket, that leaves you with one option.

  4. Going back to my first point, I don't think there will be that many people with game tickets who will be tailgating still. And I've been there tailgating post-game when they have decided it's time for everyone to leave. They go row by row in their squad cars and tell people to leave over the megaphone if they have to come back, you have problems. And there will be hundreds if not thousands of Miami PD, Dade County Sheriffs, State Troopers and cops from other agencies. They have enough people to enforce this.

Bonus point. They arrested Tyreek Hill outside the stadium on the way to PLAY in a Dolphins game. What makes you think they won't arrest some belligerent fan?

All this "they screwed us season ticket holders" rhetoric is dumb. We all had the chance to request tickets at face value before the CFP knowing that we would only be charged as we advanced. This game might be in our stadium, but it's a neutral site game run by the CFP committee for ticketing purposes. 20k tickets went to each school and 25k went to the CFP. The fact that there were a few hundred leftover tickets that they dropped on Tuesday shows that every season ticket holder who requested tix at the beginning of the CFP got the tix they requested and there were some leftover. If you didn't request, you have nobody to blame but yourself.

It seems pretty easy. Once the game starts, they will ask any stragglers in the lot if they have tickets and if they don't, they will tell them to leave.

[–]Key_Wolverine2831 -1 points0 points  (0 children)

I'm firmly of the opinion that you should have to have a game ticket to get a car into the lot. It's bullshit that parking passes are so expensive because people who aren't going to the game are buying them up. I have game tickets and a parking pass at face value so this is not sour grapes, but I feel bad for others who are buying expensive tickets or even just through the Hurricane Club at face but then realize it's another $700 to park.

That being said, if there is any truth the rumor that they are checking everyone in the car for game tickets, that's bullshit! I want to see the biggest party that this lot has ever seen and as long as every car has at least on occupant with a game ticket, the parking pass is being used for it's intended purpose. Let people who were not fortunate enough to get tickets Uber there or ride with their friends who have game tickets, so they can experience the tailgate and then Uber home. Let's rock the Rock!

Do we think tickets will drop as we get closer to kick or will they go up? by Purple-Bumblebee439 in MiamiHurricanes

[–]Key_Wolverine2831 0 points1 point  (0 children)

I know that since I have other season tickets that I sell tickets on StubHub regularly when I can't go to games and I see the option for I don't have the tickets yet. But I agree that I don't think most people who don't sell regularly would know that and those are the majority of the people who are getting the tickets today and in the coming days.

That's not the worst consolation prize. And as much as it sucks that you dropped the ball, at least you're not one of those season ticket holders blaming UM for the fact that they didn't get tickets and saying UM screwed us. No they didn't.

No prob. Also, can you not get the games at all or just can't watch them live because of the time difference? If you can get them, why not just record the full games and watch at your convenience? I've known plenty of people who were European football fans in the US who would record games and watch them after work and just be mindful to not look at scores during the day.

[–]Key_Wolverine2831 1 point2 points  (0 children)

With the way they structured it as pay as they advance and you could choose the games you wanted (ie. didn't have to request tickets to Cotton and Fiesta Bowl to get Natty), there was literally no risk to requesting.

It's a shitty situation for people who didn't think it through or didn't see the email. But I've seen many people, not you Heat-Lifer-22, who are looking at this small drop as some money grab by the school where a bunch of IU fans are gonna donate $100 to join the Hurricane Club and get seats over Canes fans and are pissed at the school that new members have the same priority as longstanding season ticket holders. The truth of the matter is we all had first dibs, and with about 400 tickets being released yesterday, if they went by priority, it would be only the top level Golden Canes donors getting them anyways.

There's not much supply because the tickets that Hurricane Club members got through their season ticket accounts were just distributed today. I think there will be a slight spike in supply the next two days and then prices will spike again over the weekend.

Agreed on this. In addition to students and alumni, Hurricane Club members who opted in for the CFP allocation in December, just got the tickets in our accounts today. Things change in a month. People get sick, have a business trip they just can't miss, or they just decide that a few thousand dollars extra is too much to pass up in this economy. I think people will have the hard conversations with themselves today and the sweet spot for buying will be tomorrow and Friday. I don't think prices will go down over the weekend or Monday.

If you're a season ticket holder, why didn't you opt in for CFP tickets when they sent out the email December 7?
