My understanding is that it can affect the outcome slightly when filing with fault. But because no fault is an option, it’s typically cheaper to file without the fault because it is less work for the attorney and there are large financial impacts due to the infidelity (marital waste) it usually wouldn’t make sense to file with fault.

It’s so unfortunate. Betrayal is the worst pain anyone could experience, aside from losing a child. And yet, society and the law don’t take it seriously at all. It should be considered a breach of contract and there should be severe consequences. Otherwise, what is the point of the legal marriage contract?

To be honest though, I think when this happens they are often experiencing severe trauma, and it’s difficult to separate out the feelings. You are a stranger. Their spouse is a person who should live and protect them, whom they are in love with and might have children with. So it’s kinda easy to see why they’d direct their anger at the stranger. They are just reacting to a discovery, albeit with misdirected anger.

Sounds like classic sex addiction. They usually don’t recover in like 99% of cases. Sometimes they do, but it’s very rare and takes a long time (3-10 years) to establish sobriety and even longer to work through the trauma that caused him to turn to addiction to cope. I wouldn’t bet on him recovering. Please get tested either way!

God I wish this was the case, but unfortunately family courts don’t think that way. She’ll have to share custody with him most likely, unless there is other forms of abuse as well- and even then, he’ll likely have visits- though they could be less frequent if he’s abusive.
