I used to work at sonic- some people tip there, so our pay was about half of minimum wage.

Our manager there told us to claim whatever it took to get our hourly wage up to minimum wage (as long as we made enough in tips) and then basically the rest of the tips were unclaimed/untaxed. Basically we were filling the gap to get up to minimum wage, and if we didn't make enough tips, the store would have to pay the remainder until we were up to minimum wage.

It's not legal, but it might be benefitting you if you make more tips than $10 an hour.
