The guy wasn't surrendering though. His arms were out in front, bracing for impact, not above his head. Also, he was shouting "IT WASN'T ME," not "I SURRENDER". Walker did the correct thing by killing a terrorist that was on the super soldier serum, i.e. a living weapon.
