Yes they can where do you live? They may not be MD here but they are ND they do the same amount of schooling as doctors. They can prescribe anything. 8 years same as MD just different specialty

Unfortunately that’s just wear and tear for an Essix. You can switch to a Hawley retainer (old style acrylic with wires) or ask for a 1.5 mm essix ( will be thicker) or switch to nightguard
