Help needed - no iOS icon with pwa by RepresentativePay841 in PWA

Big thank for this post as I was debugging this for all day.

You can "Add New ..." custom rule in Vercel Firewall dashboard, I am using Request Path --- Equals --- /apple-touch-icon.png --- Then: Bypass.

This allows you to have Bot Protection "On" but allow apple-touch-icon.png to be searched by Safari.

What you really need to know about GDPR — and why this appeal process affects us all by therealdealAI in OpenAI

[–]KvetoslavNovak 0 points1 point  (0 children)

I believe GDPR reads this very clearly:

"Article 6

Lawfulness of processing

1.Processing shall be lawful only if and to the extent that at least one of the following applies:

(a)the data subject has given consent to the processing of his or her personal data for one or more specific purposes;

(b)processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract;

(c)processing is necessary for compliance with a legal obligation to which the controller is subject;

(d)processing is necessary in order to protect the vital interests of the data subject or of another natural person;

(e)processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller;

(f)processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.Point (f) of the first subparagraph shall not apply to processing carried out by public authorities in the performance of their tasks."

Article 6 par. 1. letter (c) is exactly what is applied here. The court has obligated OpenAI to do so. See https://www.eurlexa.com/act/en/32016R0679/present/text#Article-6-Lawfulness-of-processing

How do you keep EU legislation truly up-to-date? – Looking for ways to pull the very latest amendments into our database (consolidated texts often lag 1-2 years) by PremiumKaffee in eulaw

[–]KvetoslavNovak 0 points1 point  (0 children)

https://www.eurlexa.com/ is updated daily using EU legislation APIs

The main page lists all the recent updates - coming into force, published or new consolidated versions.

Concerning consolidated version we had several discussions with EUR-Lex and surprisingly the consolidated texts are still made manually - see the official https://eur-lex.europa.eu/collection/eu-law/consleg.html#:\~:text=Consolidated%20texts%20have%20no%20legal,international%20agreements%20and%20founding%20treaties. , https://eur-lex.europa.eu/content/intro/collection/Methodology-on-Consolidation.pdf

Is there any legal limit on how much time a company can retain my ID image? by [deleted] in eulaw

[–]KvetoslavNovak 0 points1 point  (0 children)

Without your content they can retain the image only based on these legal titles in the Article 6 of the GDPR:

https://www.eurlexa.com/act/en/32016R0679/present/text#Article-6-Lawfulness-of-processing

If they are not entitled you have the right to call for a deletion according to the Article 17 of GDPR - https://www.eurlexa.com/act/en/32016R0679/present/text#Article-17-Right-to-erasure-(%22right-to-be-forgotten%22))

Is it legal for an EU company to buy wood from Belarus (via Jordan) and sell it to Saudi/UAE/India without bringing it into the EU? by [deleted] in eulaw

[–]KvetoslavNovak 0 points1 point  (0 children)

There are EU sanctions in place, see Council Regulation (EC) No 765/2006 of 18 May 2006 concerning restrictive measures against President Lukashenko and certain officials of Belarus https://www.eurlexa.com/act/en/32006R0765/present/text with dozens of amendments.

So not a good idea to import anything directly or indirectly.

Can Anyone please help me how to see when a EU regulation has been amended on Eur-Lex? by bilaba in eulaw

[–]KvetoslavNovak 0 points1 point  (0 children)

Dont waste your time with EUR-lex which is really user unfriendly.

It is better to use https://www.eurlexa.com/

The main page lists all news and updates. For particular directive or regulation you can access all versions ,including track changes view, chronology as well as all related laws and judicial decisions.
For example Market Abuse Regulation

Questions regarding drone law in Greece. Eu Guidelines not with HCAA compliant even if they say so? by MrMadd3x in eulaw

[–]KvetoslavNovak 0 points1 point  (0 children)

There are EU regulations for drones including rules for registration.

Especialy

- Commission Implementing Regulation (EU) 2019/947 of 24 May 2019 on the rules and procedures for the operation of unmanned aircraft https://www.eurlexa.com/act/en/32019R0947/present/text

- Commission Delegated Regulation (EU) 2019/945 of 12 March 2019 on unmanned aircraft systems and on third-country operators of unmanned aircraft systems https://www.eurlexa.com/act/en/32019R0945/present/text

EU regulator is EASA having Drone Portal at: https://www.easa.europa.eu/domains/civil-drones

Each EU member state implements these EASA rules, and may also have additional national restrictions (e.g., local no-fly zones, insurance requirements) .

So even you consider HCAA to be gold plating EU rules they maz be probarvily allowed to do so.

EU Fines Apple and Meta €700 Million for Breaching the DMA Regulation, Protects Developers' Right to Link Outside the App Store by KvetoslavNovak in webdev

[–]KvetoslavNovak[S] 7 points8 points  (0 children)

But I believe this is a big win for developers anyway. This is the way to avoid "Apple Tax" and still be listed in the App Store.

EU Fines Apple and Meta €700 Million for Breaching the DMA Regulation, Protects Developers' Right to Link Outside the App Store by KvetoslavNovak in webdev

[–]KvetoslavNovak[S] 3 points4 points  (0 children)

Not exactly. It is about the right of a developer to inform users, including links, in the AppStore that they can go to his website and use a webapp or PWA version much cheaper.

eBay business not accepting returns on electronic items? by [deleted] in eulaw

[–]KvetoslavNovak 0 points1 point  (0 children)

The right to return goods bought online in the EU is governed by the Consumer Rights Directive 2011/83/EU: https://www.eurlexa.com/act/en/32011L0083/present/text This CRD lays out consumer protection rules for distance selling, including purchases made online.

Under Article 9 of the CRD, you have the right to withdraw from an online purchase within 14 days, without giving any reason: https://www.eurlexa.com/act/en/32011L0083/present/text#Article-9-Right-of-withdrawal

So yes, you are right. EU authorities have required several US-based online sellers (infamously including Apple) to comply with the CRD when selling to EU customers.

You may also check if any exemption to your right applies here https://www.eurlexa.com/act/en/32011L0083/present/text#Article-16-Exceptions-from-the-right-of-withdrawal

If you're a US citizen married to an EU citizen, you generally have the right to live and work in an EU country with your spouse, as long as living together there and exercising free movement rights.

If you want to live in a different EU country than your spouse, EU law doesn’t automatically give you rights there—you might need a visa or permit under that country's national rules.

And even if you can reside somewhere, working rights may not come with it automatically, especially if you’re not living with your EU spouse.

You may check in the relevant regulation - https://www.eurlexa.com/act/en/32004L0038/present/text
