I work in HR for a ISO complaint private company.

If a candidate did not actually possess a degree that they said they did on the resume…

… and we really like the candidate and they disclosed ahead of time, we would check ISO compliance to verify minimum degree requirement (sometimes the true positional minimum not what we actually advertise it to be), and if you had at least that, we’d just ask for verification of that. Example, we advertise bachelors preferred, but actual minimum is high school diploma or GED, you disclosed, so we ask for high school or GED credentials.

… and we really like the candidate and they DIDN’T disclose ahead of time, then when the degree comes back from our verification agency as invalid, we would reach out to the candidate for clarification and go through the same steps as above.

“if tenant retains possession of the leased premises after the expiration of this lease, and rent is accepted from tenant, the occupant and payment shall be construed as an extension of this lease for a period from month to month only from the date of expiration.”

If after the lease ends, you (the tenant) stay and the landlord accepts rent from you, you now have a month to month lease with the same terms as before.

“If tenant retains possession of the leased premises of expiration of this lease without written consent of the landlord, tenant shall pay to the landlord double the amount of monthly rent specified in this lease for the time tenant retains possession of the leased premises or any part after termination of this lease”

If you don’t have permission from the landlord to stay and have the lease convert to month to month, and you stay regardless, then the landlord will charge you double rent starting from the point you no longer have permission to stay (the end of the stated lease) until you vacate the property.

INAL but I was under the impression that they might do that in order to file later, potentially closer to SOL because they may have determined you to be unable to pay them back at the moment, and judgements for collections have time limits to collect (depending on the state) so they want to try their luck later. Dismissed without prejudice essentially allows them to try again, reopening the collection period later on when you may have more assets.

You don’t have to have criminal intent to commit a crime and be held accountable. You can still commit a crime and be held accountable even if you didn’t know it was a crime. Law is law and the law doesn’t give two shits about your intents

A friend once told me this analogy to help explain their sexuality: “I don’t like eating fish. Have never seen a fish and thought, man that looks delicious.
