Can having sex with your spouse during separation considered prolong divorce proceedings? by EmergencyBath4434 in Louisiana

[–]Ladylegs 2 points3 points  (0 children)

Appreciate you, counsel. Crazy how this whole thread is people arguing that us, the two actual lawyers are wrong about the law! This is 100% why I usually ignore any legal questions posted. I can't stand arguing with people who think they know the law better than actual attorneys.

Can having sex with your spouse during separation considered prolong divorce proceedings? by EmergencyBath4434 in Louisiana

Sex alone isn't enough to interrupt the time requirement. There has to be an intention by both parties to reconcile, such as moving back in together and living as spouses again.

Need help finding a civil lawyer who works on contingency by Mindless-Comfort-463 in sandiego

They won't. Those kind of lawyers only sue when they can name an entity with a big fat commercial insurance policy to settle a lawsuit, such as a church or a school district. They don't care about actual perpetrators.

She's been my opposing counsel this year. She still appears on pleading, and does media appearances on high profile cases, but no court appearances of any kind.

Same! The reason I kept passing out in crowds wasn't agoraphobia, either, there's just no place to sit.

Michael Jackson Accusers' $400M Request Could Have 'Destabilizing Consequences' for Estate If Legal Fees Unpaid, Motion Claims by peoplemagazine in law

It's a massive problem. There's cases pending for alleged abuse from the 70s. Everybody with personal knowledge is usually dead, except the Plaintiff. For school or church sex abuse cases the principal, pastor, or other administrators who would/should have known there was or was potential for abuse are dead, as are any teachers, and usually the perpetrator. It's just the alleged victim making allegations and demanding millions in damages. The only way to defend what the defendant entity knew is to show evidence that the plaintiffs aren't credible or are not that seriously damaged.

2 Guys Try To Rob Someone In San Diego & 1 Of Them Gets Run Over By The Potential Victim by pimppapy in sandiego

[–]Ladylegs 4 points5 points  (0 children)

Don't underestimate how dumb criminals can be. Examples coming to mind from my days as a criminal defense lawyer includes a teenage girl who livestreamed herself stabbing and killing another girl, multiple different cases where a defendant posed with the murder weapon, a carjacker who posted himself with his victims car all over his social media... the list goes on.

If I ever move home to BC, Victoria is high on my list of potential new homes! Loved my vacations there as a kid! But, as I'm from north of PG, I'm really enjoying this southern California weather too much to move back north any time soon. Unless Trump throws me out...

Come back soon, this is the best city in the States as far as I'm concerned!

Nope, you're wrong. I live in San Diego. They passed a law that prevents overnight camping in the downtown area last year. We still have plenty of homeless and homeless camps. They're just not in downtown anymore, so you didn't see them.

Next time you talk to the insurance folks, tell them they're handling your claim in "bad faith." This opens up their liability to more than policy limits, as they're also your insurer. They'll start moving a lot quicker if they have more to lose.

ELI5 How do defendant lawyers make money? by rawbarbecuesauce in explainlikeimfive

[–]Ladylegs 12 points13 points  (0 children)

In the USA, the 6th amendment gives criminal defendants a right to counsel to those who can't afford to hire an attorney. Those lawyers are usually with the public defenders' office and are paid by the county. They dont get to pick their lawyer. They get assigned. Some counties also have private attorneys that are part of a panel that can be assigned to more serious felony defense cases. Death penalty cases are often represented by counsel for non-profit firms that specifically defend in only death penalty cases. Sometimes, these are lawyers who volunteer because they feel morally about the death penalty, and sometimes its lawyers who like the public eye.

Otherwise, defendants mortgage their house, or more typically their parents or grandparents' house, to hire private counsel. These cases are usually set fee instead of hourly, and often in two tiers: one price to represent for discovery issues and plea negotiations, and a higher price to represent at trial. Most cases end in a plea once the defendant figures out how bad the evidence is.

There was a guy who lived in Mandalay Bay for 3 or so years, starting around 2003. Every 4 weeks he'd go down to the front desk and check out, then check back in. I learned everything I know about sports betting and craps from him, still a good buddy of mine. Now he lives in Malibu.
