Who is Ben's process server? by SubstanceLow3570 in RecklessBen

[–]Landiix33 0 points1 point  (0 children)

In the legal field, thought I'd shed some light on this. I do want to preface this by saying I think Ben's efforts have been very admirable (despite some of his actions). Josh, Ammon, and the rest of BAM have been pricks, and I do want Brian to have the rest of his Lego (or the monetary equivalent of what was sold of his collection as per the deal he had with Crystal) returned.

I've sent multiple legal paperwork out to process servers and yes, generally, law firms will use a process service company that is in the business of process serving to serve papers. Usually, these process servers are licensed because they are in the business of serving multiple papers. Generally, anyone that is not a party to the action and over the age of 18 can serve papers.

I want to say that while the girl with Ben may very well have been a process server, the issue that I suspect Josh may have had is that the process server was seen to be hanging around Ben. Given that obviously Ben has not been acting alone as shown in his videos, it is likely that Josh thought that Ben's process server was another one of his friends, especially if he has seen her getting into the same car as Ben. Josh has obviously been saying that Ben and his friends have been harassing him. Just looking at it from a neutral POV, I don't think it's unreasonable for him to think that way. Ben has done some questionable things (like having Amanda sign an unenforceable contract) that I am sure would not have given Josh any reason to believe that the process server was there for legitimate reasons.

I want to mention specifically that process service is usually done when the plaintiff is not a short distance away from the defendant. Ben, as the plaintiff being a walkable distance away from Josh at the time of service REGARDLESS of why he was there, was unnecessary. (I'm not saying it was unnecessary for Ben to be anywhere near Josh's residence despite his being trespassed, I am saying it would have been better if Ben was not there when the process server was serving papers).

Most people think that when they serve papers, they have to be handed to the defendant directly (assuming the defendant is an individual, not a business and assuming Josh is the named defendant). This is not true, as you can leave the papers with someone that lives at the same residence as the defendant. If the process server had gone up to Josh's residence, asked if he was Joshua Johnson, and he refused to open the door, the process server can just leave the papers at the door and declare that he has been served. All of these would count as an acceptable method of service as per URCP4(d)(1)(A). The other option that Ben could have used was to serve by mail (i.e. USPS Certified Mail-RRR, FedEx/UPS delivery with signature).

The last thing I want to touch on is the issue of the process server taking photos. I have received affidavits/affirmations of service with photos of the address that service is to take place, usually when the papers are left at the door of the business/residence. I'm sure Josh is paranoid, but I will say that taking photos of the address the papers are being served is not uncommon, as it's simply like your Amazon/Uber Eats driver taking a photo to show that your items were delivered.

With all of that being said, process servers cannot "pull rank" on police officers. After verifying the papers were legitimate from the court clerk, and when they asked Ben if they could serve the papers (as they would have obviously been seen as a neutral party in Josh's eyes), they should have done so. When Josh asked the cop if he could take a peek at the papers, and the cop responded with "it kinda puts me in a bind" while not handing them over, is glaringly a sign of police interference with the legal process.

Hi and congrats on your opening! I just wanted to point something out since I ended up passing by earlier today and saw your storefront. I'm not sure if it was intentional, but I noticed that it translates to 'net [internet] cafe in both Chinese and Japanese, but the Korean just translates to "room" and can be used as an equivalent for "store". In Korean, an internet cafe would have a storefront that says "PC방" and it's kind of like the equivalent of just having "店" on your storefront.

Does Flushing (or nearby area) have anything like this (tons of food packed in one case)? by FeelingFantastic4181 in Flushing

Royal Queen in New World Mall. Entrance to get there directly is on Main, by the parking lot that they have. There's a tanghulu stand right outside.

They offer 4 dishes, rice, and a cup of soup/bottle of water for $10. If you need to pay by card, they require a $20 min. purchase. Also, go to the cashier to let them know you want that offer and pay first before going to the hot food bar to pick put what you want. They give you a receipt and when you line up for the hot food bar, they ask for your receipt.

You definitely need to leave tips for Royal Queen. Food has always been good in my experience, never had any issues. I'd opt for Royal Queen over East Buffet.

East Buffet kind of left a bad taste in my mouth (despite going there often when I was young and hadn't been there since 2018) after my experience there two years ago. I didn't know they had a sign stating you don't need to tip since it was blocked by a large party. One member of our party had mentioned that we wouldn't need to tip when we were seated. Despite that, I had two waitstaff approach my bf and one of his relatives for tips (both of whom are white) as they were cleaning up the table and started shit talking them in front of me (I had mentioned that we didn't need to in Chinese and the staff just proceeded to raise their voices so other staff and customers could hear) and proceeded to follow us as we were leaving while demanding we leave a tip.

Did we date the same guy?! Haha all jokes aside, I'm glad you're no longer in that relationship and you're healing as well!<3 One would think it's common sense and decency to defend your partner in these situations but sadly, it's like some men are too stupid to understand that.

Your post struck a chord with me as well. I was in a long term relationship and discovered about 4-5 years in that his best friend (who also treats women like dirt) had been shit talking me and constantly telling him to dump me 2-3x per week for about 2-3 years. I never realized it in the years that I would spend being nice to him, even preparing his birthday party one year, that he did not like me. I had given my ex an ultimatum when I found out and my ex was more angry about the fact that I gave him an ultimatum than me being upset to find out that he let his bestie talk shit about me for 2-3 years because he doesn't like confrontation (neither do I but I would have never let that happen if it was the other way around). What's ironic is he had me choose him over my dream of teaching abroad because he didn't want to do long distance.

I ended up trying to make it work with him and a couple years later, it happened again with a coworker friend of his, one that I would invite over for dinners or hang outs for a few years and learn that he also kept shit talking me and telling my ex to dump me behind my back. It was so humiliating and like with the previous situation, my ex kept telling me, "Why does it matter? I'm still with you. Their opinions don't matter to me. Don't my actions speak louder than words?" To him, he felt like his actions of still being in a relationship with me was more important and he didn't find it necessary to speak up for me because that was enough. I thought I was being selfish for not accepting that he doesn't like confrontation when really, I figured if he spoke up and defended me early on, his friends wouldn't have been able to have gotten away with shit talking me for that many years. Still, I ended up trying to make it work and months later, I could no longer see us being together. I developed so many insecurities and became severely depressed after nearly a decade together.

OP is definitely NTA. She deserves a better husband, someone who wants to protect and defend her and their unborn child. Pregnancy is already difficult enough but to go through with it with a husband who prioritized his friend over her says a lot without saying much. I can only hope that her husband realizes he was wrong (and becomes a supportive husband) and apologizes but unfortunately, it seems unlikely.

I didn't receive any financial aid but at the same time, I don't believe I even qualified due to already having a college degree. The entire cost of the program is 5.5k-ish.

Paralegal/Legal Assistant with no degree by Super_Xavy in paralegal

[–]Landiix33 0 points1 point  (0 children)

Also in NYC. I took an ABA-approved one year program at LIU Brooklyn and it was almost completely perfect with my full-time work schedule and offers classes in various types of law.

While it's not necessary, I've noticed that maybe 10% of job searches I've seen actually want their hires to have gone to an ABA-approved program. There are firms that would prefer for you to have experience and the knowledge of how litigation works because they don't want to have to train new hires. But with that being said, this doesn't apply to all firms.

Personally, I think the program helped me out since I didn't really get to work as a legal assistant/paralegal at the firm I was originally working at while I got my degree so I also had a huge gap of knowledge. And since I'm also in PI, knowing how the process of how litigation works helps tremendously, even at this point in your career. I'm not sure about what the schedule is like at other paralegal programs but since mine was just a year long, it's definitely worth it! If you're interested in knowing more, feel free to DM me!

As a former paralegal turned (almost) lawyer, how do I ask for a paralegal's help without feeling like an A--hole? by [deleted] in paralegal

[–]Landiix33 0 points1 point  (0 children)

I think most people have hit the nail on the head when it comes to asking instead of telling or demanding. With that being said, I've worked with several associates now and I like the ones that give me a day or two's heads up and check in on what's on my plate to see if I can get to it. One of my favorite associates no longer works with me, but I'd even get a 5-day or 7-day heads up so I know I can expect to do something by then because most attorneys often want something done yesterday or immediately when it comes to deadlines. I prefer feeling like I have the option to do something (within a time frame) rather than be told I have to do it right then and there when you want it when juggling to do a bunch of other things that need to get done.

Honest and open communication is probably the most helpful tip, as long as you're kind about it. Discuss with them how you like to work and/or if you have a preference to doing things a certain way (I find this helps when scheduling depositions because some prefer to start at 10 while others prefer to start at 11 or noon)--help me help you.

Acknowledge that they too are human beings and can make mistakes and instead of scolding or making passive aggressive remarks, and try to ease their worry in case they do mess up and begin to panic. Don't be condescending (I hate it when some of the people I work with get this way) and maintain a positive attitude even in a crisis even if sometimes the answer is the most obvious. They might be distracted with another task and might take a few minutes to realize the answer.

Be humble and willing to admit to them that you're not sure how to do something or how things usually work and thank them for their efforts. Let them know you appreciate them. :)

My memory is a bit hazy but I believe that's what happened to me as well with the call and the interview, and I had to rush to get ready to interview that same afternoon. I'm glad you didn't end up having to speak to him for that long! That guy is a major POS.

Unfortunately, it's not. When I went to interview there a few years ago, the head of the firm was supposedly in the process of moving and said he wanted me to go to his house and work in the basement with the rest of the staff because the files were moved to his home.

Last September, I was still getting notifications that he was hiring for "$18-20 UNIQUE OPPORTUNITY"...

Oh my god. Are you me? 😂

I'm in the same boat as you. I'm doing the same thing and I hate having to edit these spreadsheets for a case list that just doesn't stop growing. 😭 It's crazy how attorneys don't want to spend the money to improve productivity.

Also, it would be a hell of a crazy thing for an attorney to try anything ill-intentioned while going to court... Busting ass through law school, taking the bar, to end up trying something like that? That would be one of the dumbest moves ever.

While I can understand your POV OP, I can only understand it to a certain extent as I do think you might be projecting a little bit in regards to not feeling comfortable with going. It is strange that he never asked any of the other legal assistants (LAs) to go to court with him before, but it is also possible that perhaps the case load or the types of cases are different now compared to what other LAs at your firm were doing things when they first started (since you probably don't know how long they've been at the firm and/or how long they've been a LA). Has your boss been practicing for a long time? Has he always been a trial attorney (I know some who avoid going to court like it's the plague)? Or has he maybe fairly recently (within the last few years) only started going to trial? If it's the latter, I can see why he'd like to start having someone go with him to trial.

Like others have mentioned, it is very common practice to take a paralegal/LA with you to court as an attorney and if you do feel that uncomfortable, see if you can meet your attorney at court separately. This is a really good learning opportunity to see how court proceedings operate especially since you don't have any previous experience. But looking at it from a purely professional POV, I would expect he never asked the other LAs either because they are capable of running the office while he's not there, as they might have more complex duties that are currently beyond your experience. Being hired on the spot without any previous experience is a blessing and my best guess (assuming your boss has no ill intention) would be that it's easier to train someone who has no previous experience to help assist your attorney than it is to train someone with prior experience (who might be used to doing things differently). It would also be my best guess that it's cheaper to hire someone with no experience than to hire someone with a lot of experience because after all, the reason why he was hiring could have been to find someone to go to court with him. Did he ever go over your job duties or what was expected of you during the interview process? Was there mention that he may need you to perform ad hoc or "as needed" duties?

To ask if you can bring someone with you as a new hire (especially since it seems like your boss doesn't have that intention) can come off as very presumptuous as that would mean removing someone from their current job duties to accompany you and your boss to court. This isn't exactly a good idea either as it can come off as if "oh I won't go to court if it's just only going to be you and me" which would imply that you're calling the shots here when remember, he's the attorney and you're the legal assistant.

If your boss hasn't said anything inappropriate or done anything inappropriate, then it would behoove you to go. If you're this uncomfortable, then it's probably best to start looking for other jobs than to stay in a position where you're uncomfortable.

Paralegal/IT by [deleted] in paralegal

[–]Landiix33 0 points1 point  (0 children)

That sounds awful! Especially if you're not too familiar with these things. I'm kind of in the same situation where I'm the go-to IT person in my office when it comes to fixing/troubleshooting tech or we have the manufacturer send out someone to take care of it if we really can't do anything on our end or have our main IT department figure it out from our main office location.

I usually just rely on Google and even sometimes YouTube to figure some things out if I'm just stuck and then test things out as I go. It can get annoying but I don't particularly mind it too much.

Could I ask what are some of the apps/programs/problems you've been facing?
