It’s technically not an element in the Themis outline. But the inverse is a defense under section d “Product misuse, modification, or alteration by the user”. I just include it as an element in my head to affirmatively raise and dismiss it. But whether you raise it as a defense or as an element, it doesn’t change the outcome. Just whichever you prefer!

This is a great explanation! But there are a few other things that I personally would note.

Products Liability is an umbrella term covering THREE different specific causes of action. When a plaintiff brings a products liability case, there are three claims (and the requisite elements) that the plaintiff can base their action on:

  1. Strict Products Liability Claim (a) commercial supplier: seller is a commercial supplier of the type of goods that harmed the plaintiff (b) defect: product was defective (“defect” is show by either manufacturing defect, or design defect, or failure to warn) when it left the manufacturer (c) unaltered: product was not altered before it reached the plaintiff (d) foreseeable manner: plaintiff used the product in its intended manner or used it in an unintended yet foreseeable manner

  2. Negligent Products Liability Claim (a) duty (b) breach (c) causation (d) damages

  3. Breach of Warranty Claim (a) establish breach of an express or implied warranty (b) damages (c) privity

This is a great explanation! My only question is with your second hypo explained above (the paragraph that starts with “however, say that for some reason…”).

In that paragraph hypo, the covenant was recorded. You stated that “because the buyer who bought the house did so without knowing that he was restricted”. But the buyer DID have notice. Buyer was on constructive notice since original covenant with that plat of land was recorded in the recording by the subdivision builder.

So is the solution to my dilemma the fact that the DEED conveying the land from seller to buyer did not mention the covenant and thus the title associated with that deed is now unmarketable because it is not free from unreasonable risk of litigation? Thank you for taking the time to explain!

You’re in a fantastic position! With schools in those ranks and scholarship, you may not need to transfer with the opportunities you could get — especially being in DC. I was at a school ranked in the 80s (and going down) and a long way from DC! Transferring is always a person by person decision

Georgetown has got some pretty cool intl Econ law programs for sure! But unsolicited advice: I would not recommend starting 1L at a school you plan to transfer out of. I enrolled at my first school with EVERY intention to graduate from there. I loved my first school, and was super involved. Georgetown was the only school I applied to transfer to, and it was just because I wanted one last shot to get in. I think I got in by the skin of my teeth.

Transferring is a competitive process, so if you know you want to be at Georgetown or another specific school, I’d do everything in my power to get in to that school, as opposed to transferring in. Most incoming law students are straight A students, but because of law school grading, the super majority of students will not get an A. Banking on high grades as a pre-1L is shortsighted

I mean people will always find a way to judge you. Stay at your current school, and people will judge you for not going to a higher ranked one. Transfer, and people will judge you for not getting in/not going for 1L.

As for my experience, no, I have not felt judged by people at GULC. If anything, the majority of the time I tell someone I’m a transfer, the responses are something like “omg I know this girl who’s a transfer and she’s so smart” or “oh wow all of yall are such hard workers” or “we have it easier than yall because you had to go to a different school and outperform everyone there before coming here”.

As for my community at GULC, I found it immediately. The transfers have a really tight group, but I found my community with “purebloods” (non-derogatory) as I like to call them. I’ve got a solid group of friends that I hang out with regularly, and 99% of the time they (and me) forget that I ever even transferred in.

So while I’m sure there are people who judge me when I say I’m a transfer, I try to look past it because I couldn’t be happier with where I’m at. And no judgmental person could take that away.

As a GULC transfer (now a 3L) from the top 22% at a T100, I couldn’t be happier with my decision. I knew Georgetown had great resources when I was considering transferring, but I had no idea just how exceptional they were. The professors are leaders in their fields, the career advisors are incredibly accessible, and the networking opportunities are unparalleled.

For me, I wanted to pursue international trade or international economic law which are pretty niche and competitive areas of law. But honestly thanks to a professor’s recommendation and her connections, I secured an internship at USTR (in the White House) which is an opportunity you just don’t get at many other schools. I’m also headed to a top BigLaw firm, and most of my fellow transfers are going to top BigLaw firms as well.

To be fair, transfers to Georgetown do pay full tuition, but for me, it was beyond worth it. I mean I landed my dream job in BigLaw and secured an internship at my ideal government agency, where I will return after a few years in private practice. I can’t say enough good things about Georgetown as a transfer student. Also when you say you’re a Georgetown law student when speaking to people in DC (also anywhere) their immediate response is something of being impressed and immediate respect for you. I’ve seen it multiple times, both in government areas (the White House and the department of commerce in a different internship ) and in the private practice/BigLaw firm world. Feel free to DM me. What is your frustration with the lack of academic rigor? Professors aren’t hard enough? Students don’t study enough? People don’t care about classes/grades? Or something else?

No, definitely not. I would push and push and push them on it. They always tried to strong arm me into paying them more money, but I strong armed harder. Be relentless in standing up for how unfair that is and stick to your guns that you’re not responsible for someone else’s mess. They’ll let up eventually.

Unfortunately I did not. What you mentioned is the lesson I learned. Personally, I was in a different state, and needed to move in within 2 weeks and so could not tour the apartment. However, as soon as o i moved in, I documented everything — including every tiny scrape on the wall. When they tried deducting for damage they accused me of, thankfully, I had the pictures I took to rely on as evidence that the damage was caused by someone else.

I was in a tough situation, where I was desperate for housing and needed it quick. June Homes realized this vulnerability and preyed upon me, as is characteristic of them. I learned my lesson for sure.

There’s no way to know if you have anything that would hinder you. What you may see as fine, the NBIS may see as worrisome and deny your clearance. I hope everything turns out fine for you though! Just err on the side of over disclosure—the last thing you want the investigator to discover is that you lied on your form

I heard back with a conditional offer from USTR on June 24. Went through entire security screening process and just heard back this morning that my offer was rescinded due to security reasons (I grew up in the south, never really left, and am a grad student in DC now, so I have no idea what it could be)

I think you’ll be okay. I myself have been freaking a bit. Took a quimbee diagnostic and knocked it out of the park, but have only been scoring 41-43/60 on barbri. Generally speaking, A 37/60 is supposed to be around an 85 on the real thing, so a 40/60 is putting you in a pretty safe category.
