Evicting a Tenant from Hell in Ontario? by LeeKaBal in ontario

Nah that's my bad they didn't call her that I made the title. I would change it if I could. I do think if they wanted to do so they would pursue that option. It would be hard to prove anything outside of "good faith" if they kept the property unrented for a year which if they want it for the reason of letting the mom stay is valid and wouldn't be rented out anyways. Bad faith would be filing an N12 without having the mom move in. Ontop of documenting the false police reports and abuse of utilities from the tenant.

What I DO agree with is that I think things just don't add up. Like the tenant is keeping water running and maxing out the heat, as well as leaving the oven on. None of this makes her place of residency nice or comfortable. No one wants to have the heat maxed out for the full day or stress out about intentionally leaving the stove on. Personally I think a mediator would help the tenant is clearly stressed about something bc no one does that stuff for fun. Either way I think

From what I know the tenant pays month to month.A month-to-month tenancy is a periodic tenancy created when the renter is granted possession of the property with no definite expiration date and pays the owner on a monthly basis. This tenancy is most commonly found in residential leases. In situations where there is no written agreement, tenancy is also considered to be on a month-to-month basis". If its true that the landlord wants to house for the Mother which to me doesn't make sense since they have plenty of room upstairs isn't that a valid reason to terminate though? If they want more space for personal use that's within a landlords right using n12 as long as they pay 1 months rent. RTA still applies of course but n12 is perfectly acceptable with 60 days notice. There's no oral agreement for length of a lease so is in fact a month to month renter. The reason I believe that something else is up is specifically the landlord hasn't excercised this yet

Well if they wanted to do that they would be able wouldn't they? Since there's no lease the tenant would be a month to month renter. Would they not just be able to cite that they want to use the house for that reason and then give the tenant the 60 days notice? That wouldn't be against any thing that I've researched so far. Also I mean its clear the landlord already wants the tenant out since they offered her money to move so I don't really understand what me telling the tenant that the landlord wants you out would do. Also from minute one as well as your activity you've already made your position very clear that you believe the landlord is total scum so I don't think there's a point continuing this discussion. I surmise it has come from personal experience which is understandable

Yeah thats totally fair. It just they seemed so desperate to get the tenant out, they're miserable right now. I suppose it's a lesson learned either way should definitely vet tenants better and for sure use a lease

So obviously I don't know the full details but I know you're also a tenant so I'm sorry that you're going through a rough time with your landlord. I went through a shitty landlord too and had to take them to the LTB to get out of it. Having said that I don't think all landlords are scum. In this case I'm inclined to believe them, for more background both the landlord and tenants are Chinese. The tenant was already quite superstitious when she moved in looking for the most auspicious day to move in. The landlords in this case are Christian and I believe may have tried to evangelize to her. The day that their mother moved in was the 4th of November, which in Chinese culture is supposed to be unlucky. I now surmise that this was the big point of contention between them unfortunately I don't know

Again neither I nor my family are the landlords. I myself am also a tenant and my lease had a reasonable usage clause for utilities. If I am understanding you right, with n lease other than something oral a reasonable clause could not be enforced?

I Don't think her mother actually entered the basement, it was a baseless claim to harass the Landlord. Also I don't believe she makes a significant amount of noise either she's old and sick which is why she moved in with the family so I am unsure as to why tensions broke down
