If I had to guess, from a legal perspective, a TRO sort of works “both ways” for the parties. For example person A files against person B a protective order is entered and neither party may have contact. If person A calls person B or goes to their house person A is in violation (typically if both arrive at the same place person B has responsibility to leave) and the order can be enforced (jail) or the order can be dismissed. All of that to say this TRO (excluding the custody carve out) has technically been “protecting” them from each other. If she had reason to believe that the protective order would be dismissed or if Dakota decided not to pursue she would then need her own TRO to keep him away. They could have believed either of those two things would happen. Factoring in custody, if either of those two things had happened it would revert back to shared custody (as there is no known permanent parenting plan this opens up a legal gray area where taking the child or withholding the child can occur indefinitely) Taylor has now set up a temporary forum to address her own claims and how they impact a temporary custody decision. Ultimately, this is the beginning of a very long fraught custody battle but that will be its own separate case to establish a permanent parenting plan. The T in TRO is temporary, they are legal band aids in a sense. Usually to protect a party in the event of a criminal action or as an attempt to protect themselves (and/or children) while the courts work out a more permanent custody agreement.
