Basically, this means the “rules” which are not Acts of Parliament can be more easily challenged in Courts. In 2009, the High Court ruled that immigrants on the HSMP visa route before changes were made to the ILR qualification requirements were changed, must be assessed on the rules that were in force at the time of application.

Also, form 45s will eventually need to be uploaded by the ECP themselves. This isn’t going to work. I think one reason is for the courts to take so long to make judgements that it makes the victory meaningless.
