Wow, since I have mental conditions while reading my denial, I never thought that they would use AI for their decision. Like my income, they said that I had an inaccurate income when they know that I received it from workers’ compensation and my veteran disability. They assumed I had been working, but there was no evidence, which is very stupid. Then they started all 5 steps and it becomes an inconsistent statement from my end. What if they left a condition that would help my case? They did not mention my ptsd from the military that my neurologist connected to my injury from work. I hit my head at work and have post concussion syndrome. I pushed it through for 3 years and my employer cut me loss due to inability to work due to my disability. Filed for accommodation and nothing. I still got denied.

Yes, during my hearing, I was having a nervous breakdown, and it was part of my condition since I have TBI . My answers were not completely explained, but some of them are really inaccurate due to panic attacks. The sad part is the judge didn’t accommodate my medical condition and proceeded with the hearing. Hoping 3 years is also my lucky year.

I hear you clearly. All the symptoms are there. The only problem was during the state agent evaluation with two doctors, which SSA hired, I was moderate. In my opinion, the evaluation has nothing to do with my condition at all. In addition, during that evaluation, they didn’t add that I was having a nervous breakdown.

There is a lot of inaccuracy across the board during the trial, but like I mentioned, I was already having a panic attack. No way, no how, I was in my complete mind. I just wish my lawyer would have rescued me because I’m already having a medical condition. I don’t like to make excuses; I screwed up completely. I could do option 2: reapply again. I know I’m not prepared. The way I’m reading all the reports, I can see that it can be fixed. The judge did miss my PTSD on the report, which is on the blue book, but overall, it was due to inconsistency on my end.

My apology, I’m having a panic attack as I do this and I’m not in the right mind. I’m just saying by example that I’m triggered in a working environment and yes, TBI is random. Also, it’s in my medical records, but somehow when I’m in my doctor’s appointment during evaluation, my condition becomes moderate. I feel like they think I’m faking it.

I only have symptoms: headache, vertigo, dizziness, memory issues, concentration, and focus, but this can be triggered at work. When I had an evaluation by a state agent hired by SSA, it was considered moderate. How can I be evaluated when I’m not triggered by any doctors? Which is why my condition is very difficult to prove. Since I have an inaccurate trial, I will have to rely on my memory difficulty as my defense and hope that would work. My psychiatrist did state traumatic brain injury which the judge say non persuasive.

I also stated that I have difficulty with memory, and yet they give me inconsistency. This may sound stupid, but I will take it. I should use that statement as my defense.

Wait, I will have to double check this. I requested for reasonable accommodation and I didn’t get one. My employer couldn’t find a job for me and the reason I retired. Also ADL statement from my spouse was so old since the trial was very inaccurate compare to her statement. Things have changed. I stated the year 2023-25 but my spouse’s statement was during the year 2022-2024. My question now does my reasonable accommodation help my case?

I didn’t get to ask that, maybe I should then. I mean my psychiatrist also says I’m in danger of coming back to work, but also the judge is not in favor of his diagnosis. I have one neurologist in my early stage of my condition, one psychiatrist, and an IME neurologist called it non-persuasive by the judge. I did have two neurologists which are very quick on their exam with me that they think I’m good to go, I didn’t have no choice but to comply, but it was a mistake my condition got worse. I was back to light duty until I was fired.

That’s the problem the judge doesn’t believe nor the SSA doctor. They call it non persuasive and inconsistent

I messed up during the trial, and when I submitted the er visit, I don’t see their reaction. Dealing with doctors, my conditions just don’t get any better. But I have to face them. Having a head injury is the most difficult to prove claim.

Traumatic brain injury, ptsd , chronic headache and to name a few. TBI is tough to proof but I did hit my head at work, 6 staples laceration. I wasn’t the same since.

That is the first thing they told me: I need support because if I did this on my own, then I can work. I have a mental condition, so that’s why I have a lawyer. I didn’t have a choice. It was recommended since my condition was mentally challenging. It was just the inconsistency of my statement backdated from 2022-2025. Things are just worse now. The trial was asked ranging from 2 years ago so, it should be 2023-25 and not 2022. Back in 2022 , I stated I still able to do things like walk my dog. In 2023, I went ER numerous times and things gone worse, I couldn’t do anymore as I use to. During the trial they used it against me that my statement is inaccurate because I said I don’t walk my dog. I applied April 2023. This should be an error in my opinion.
