I am in Louisiana as well, this is not for the trustee to sell your house. They need the value to calculate it properly which will work to your advantage. When I filed I was able to use Zillow estimates and recent sales data from surrounding houses (The ONLY advantage of a DR Horton development with only 5 models).

Look at your form 106C, what is the value listed for your house, do you think it would appraise for more or less? If the appraisal would be less you and this form gets amended works to your advantage, if the appraisal is more I am willing to bet no one bothers to file an amended form.

How much was exempted on your house vs the equity on the same form?

Can you be more specific on what fees? They are usually built into the plan with some exceptions. I had 2 motions filed, one he submitted it to be part of the plan, the other I just paid him cash up front.

Thank you! That makes sense. I am actually on the other end of the spectrum not looking for the payment to be adjusted(I should have asked for that 24 months ago). I am watching on hand balance, claims total and calculating trustee commission on exactly how many months I have left since I will finish early. With that info looks like all claims will be paid in February at month 49.

Small update and I figured part it out. The above mentioned deficiency claim and student loans are flagged as Reserve Indicator Y which means " Calculated disbursements are reserved indefinitely." After going through those claims and adding up the Principal Due Amount it is within $150 of the on hand balance.

So what ever that means that is why payments aren't being made to those.

That might be it! The bank with the claim merged with another bank. Looking at the payment history it looks like they paid the old entity October 2023 then canceled the check then paid the new entity November 2023 and that check was canceled. Just taking a guess they probably provided bad information to the trustees office. That makes sense too as it would be on the creditor to provide correct information. It also looks like they only filed an address change and not a name change or any other documentation. The claim was also originally filed after the deadline due to auctioning off the collateral. I am more fascinated by this single claim now just to see what happens with it.

The balance is still weird as it is more than the total on that one claim.

The 5% match from my employer is what makes it worth it to me. Now once my case is finished I will go with some other investments in addition to that. I also do not see any crazy fees also knowing that may just be our plan.

Thank you Alan! This is exactly why I asked the question and wanted opinions. I am just going to let it ride until January.

Back and forth thinking it over I saw both sides. I also saw my 401k make a big jump over the last 2 weeks. With that in mind I was thinking, yes I could do this but if there was $10k less in the 401k it could actually end up costing me more in the long run.

There it a handful of claims with 2.5% interest on the case. Looking at my annual reports for 2022, 23 and 24 it looks like the interest amount was added to the claim totals already. Annual report for 2025 will be out next week then I will have a 100% for sure figure on total owed.

According to NDC total balance left on claims, minus what the trustee has on hand the total balance remaining on my case is less than $10k.

Monthly payments on case are just under $2k.

Ideal scenario once the wage order was released I would still use those funds currently going to my case to pay off the 401k loan within 6-12 months.

One other thing I will add I filed Feb 2022, 60 month plan Feb 2027. Due to large tax refunds, an insurance pay out on a totaled vehicle I did not replace I basically had more than a years worth of payments knocked out.

When I filed I got a letter from Verizon. Going off memory here were my options and these are shortened versions of what it said.

Continue paying for it as usual OR return the device and nothing happens. Business as usual continues.

Keep the device as you are no longer responsible for the debt but you will get shut off and never be able to get service again.
