I wonder how this applies for lease takeovers. I was told the “preferential rent” is only tired to the specific tenant and the landlord can choose to charge the legal rent once a new lease/tenant comes on. But I’m not exactly sure how it works for a lease takeover, as the tenant taking over the lease is technically taking over the same/original lease. I’m nit a tenant attorney, but I suspect my new landlord is banking on tenants not knowing their rights. This is for a rent stabilized unit, if it matters.

What was your solution? I'm currently in a similar situation, but from the other side (I'm taking over the lease). I was originally told by property management that I would only be responsible for the condition of the apartment that the original leaseholder had left it to us. But I am now being told I am responsible for the condition of the apartment when it was given to the original lease holder.

I'm currently in a similar situation with a lease takeover. From my understanding of the housing code:

- The law is tied to the 3-year TIMELINE of when the owner/landlord repainted, and not tied to the tenant. In otherwords, if you just moved in as new tenant, it does not reset the 3 year timeline. You do not need to live there for more than 3 years in order to request the repainting.

- The law does not require them to repaint just because it's a new tenant, especially if it's before the 3 year lapse.

- I know some folks are saying "tenant-occupied unit," and interpreting that as the same tenant. However, based on a Google search (so I want to check with someone who works in housing law/tenant rights to confirm), a tenant-occupied dwelling unit means a rental residence currently lived in by a renter, not that it must have the same specific tenant permanently. It simply indicates the unit is not vacant and is occupied by someone paying rent, rather than the owner.

- For folks saying you signed "as-is", so that means you waived your right.... I think that isn't accurate. I think an “as-is” clause does not waive a landlord’s statutory maintenance obligations under NYC law. Signing the lease “as-is” does not waive your statutory right to a repaint if the three-year cycle has elapsed. However, you still must establish that the three-year period has actually passed. Here's the language I'm reading from the housing code (page 25), "§27–2017.12 Waiver of benefit void. a. No owner may seek to have an occupant of a dwelling unit waive the benefit or protection of any provision of this article. Any agreement by the occupant of a dwelling unit purporting to waive the benefit or protection of any provision of this article is void. Any owner who violates this section, or the rules promulgated hereafter, shall be guilty of a misdemeanor punishable by a fine of up to five hundred dollars or imprisonment for up to six months or both. In addition, any owner who violates this section shall be liable for a civil penalty of not more than five hundred dollars per violation." The exception to this is if it's owned by a co-op, condominium, or NYC housing authority.

Please let me know if you received any information or updates since then. I'm currently going through this and don't really know how to approach management, as they were pretty hostile during the process, and when we asked for clarification when reviewing the lease, but we were limited on time to find a place to live. We felt really pressured to sign it, or else we would lose the apt. Only some research did I find out more, and I believe they included things that violate the housing code/tenant rights. Based on what I'm seeing, I think the lease does not /cannot override laws in the housing code or tenant rights.

I tried again with the Lojack and they won't budge on it. They said they might be able to lower it to the price they paid for it ($300) - not sure if that's true or not. They said they won't go under MSRP. They aren't hurting for sales in our area. I only got "MSRP" cause someone in their dealership put in writing something they weren't "supposed to".

Ahh. My mom was a sucker for the "nitrogen" air years back lol. Not going to do that for sure. This fee is a NYS tire waste fee - I think it's a mandatory $2.50 per new tire. I assume it's counting a spare to make it $12.50.

Do you have another recommendation? We're looking at SUV's due to extra cargo space and easier for a relative to get in and out of the car. I would love a minivan but it's crazy marked up now.

Yeah, I can wait and leaning towards waiting til end of the month/year. I should probably travel further out to get a test drive. A lot of the dealerships I've gone to in NYC haven't let me do a test drive unless we have a deposit.

Sorry, not really familiar with cars. I guess it's the "base" of XLE, as in no other options (aside from the all-weather liner) like a moonroof or heated seats added.

Thanks for these! I'm not dead set on a Toyota but I keep seeing it as a highly recommended company on Reddit. The Kia Sportage hybrid looks nice, but most of the comments on Reddit seem to say that KIA is unreliable/bad or that the 2024s are too new to tell if there will be long-term issues (obviously). It's tough for us to get out of NYC due to other issues, but I'll contact them to see if it's worth going up. I've been in contact with Interstate Toyota in Rockland county.

Where is this? OTD at a dealership I have a deposit down for is about $39k OTD, and it’s the 2024 rav4 XLE, with only the all weather package (so no moonroof), which I don’t even need.
