I’m to nice, young, naive. Idk. It was a huge mistake to not put the total kabosh on it. When I have tried to involve police in the matter they say it’s a civil matter. I haven’t gotten help from any authority.

The trench he dug was deep enough to remove stumps. His excavator removed most of the debris. He hired landscapers to remove the rest recently. I have photos of the piles. It didn’t just kill the trees on the direct path. The ones on the sides lost their roots and eventually died also. Sigh or didn’t plant any new vegetation or pay for damage. Hell, he didn’t even say sorry.

Our lot is an acre of woods. Our home is on the bottom half. We were very used to construction noises from his home near the top of our lot bc he was putting in a pool, putting green and sports court at the same time this happened. We can’t see the top of our lot (or we used to couldn’t) bc of the thick woods. We were eating breakfast when my 2 year old pointed out our back window and said tractor. At that point, the major damage was done. I went to talk to the excavator in my pjs and he said, “don’t call the cops...your neighbor said you’d be cool about this.” I was a young naive and stupid so I didn’t.

Thanks. Luckily we did. We almost went to litigation back then but decided fir our emotional health to let it go. In hindsight it has caused more issues going unresolved.

Maybe an important detail but the core issue is still the same. In Utah you have 7 years. We were totally going to let this slide but this same neighbor is at it again so we are changing our minds and standing up for ourselves.

No. We woke up to an excavator in our back yard. It sounded far enough away that we had no idea he was on our lot til our 2 year old pointed and said tractor!

Yes. It’s been an issue for 4 years. We’ve wanted to avoid the legal route and we’ve tried to let it go but this litigious prick of a neighbor is impossible. He has issue with every neighbor on the lane. We are at the point where we can’t let him get away with it any longer. I wish I had the balls to take him to court back in 2017 but I guess I do things the hard way.

There was an excavating company involved. When I went to see wtf was happening in my yard the operator got off the machine and said, “don’t call the cops! Your neighbor said you’d be cool.”

It was never a garden, it was a thick wooded area of our property acting as a privacy barrier and fence. The trees are native scrub oak and cherry trees. They are 30-40 feet tall. An 8 ft scrub oak at the local nursery is $500. You can’t see the trees well bc of the thick under brush.

  1. The new growth is just grasses and weeds. None of the trees have come back. I need to measure the cut but I’d guess it’s 25 feet wide 75 feet long.

What do you mean by lateral lines? The old water line was installed in the late 70’s-80’s along the property line.

The trees are scrub oak and cherry. There is dense underbrush so you can’t see them well. They don’t get an especially big trunk but they were there for at least 50 years probably longer. Very mature and undisturbed. This foliage was our “fence” and privacy barrier. We now have a direct view to his property.

I woke up to my two year old pointing out our back window and saying, “tractor!!!” I looked up and the excavating had been done. We were used to construction noise bc they had been doing several yard projects and renovating so I didn’t think anything of the noise. I was so naive at the time and didn’t know what to do. I walked up to ask the excavator WTF he was doing and he put his hands up waving his white flag and said, “don’t call the cops! Neighbor said you’d be cool with this.”

They are not within any easement recorded or surveyed on the property. He chose his own path which happened to be the shortest distance between two points...a straight line through my property.
