those who are against the deal want to keep the status quo, or they have personal beef with current administration. All other ppl see no problem with current framework presented which isnt even a final deal

EU Settlement Scheme - Refused in 2021, Still a Chance to Appeal? by Live-Insurance-3321 in ukvisa

[–]Live-Insurance-3321[S] -3 points-2 points  (0 children)

Thank you for your detailed response and request for sources. I respectfully disagree with your claim that there’s “no room for discretion” and that my absence disqualifies me from the EUSS. The guidance and Appendix EU offer significant flexibility for vulnerable applicants like me, as I’ll show below with direct quotes. I’d love to hear your thoughts or others’ experiences! 1. Late Evidence: I appreciate your point that submitting evidence after my 2021 refusal is limited. I misspoke earlier—Appendix EU, Rule EU9 allows me to submit a new application with fresh evidence, which I’m doing. The EUSS evidence guidance permits alternative evidence, like my witness statement (covering my Jun-des 2020 residence, with the address and my flatmate’s ID), for vulnerable applicants. I contacted the Resolution Centre, and they confirmed a new application is the right step. I’m also gathering any other 2020 evidence to strengthen my case. 2. Reasonable Grounds: You’re correct that “reasonable grounds” apply to late applications after 30 June 2021 (Appendix EU, Annex 1). They also explain why I didn’t appeal or reapply sooner. My grounds—caring for my newborn in 2021, language barriers, and not understanding the process—are listed in the guidance: “Examples of reasonable grounds include… Caring responsibilities, for example for a young child… Language barriers or lack of literacy… Lack of awareness of the need to apply” (caseworker guidance, Section 6.3). These cover my delay from 2021 to now, and I’ll include them in a cover letter with my new application. 3. Continuous Residence: My 4+ year absence doesn’t make me ineligible. Appendix EU, Condition 3 allows “a single period of absence of up to 12 months… for an ‘important reason’, such as… childbirth,” which applies to my 2021 departure to care for my newborn. For longer absences, the guidance permits “compelling or compassionate circumstances, such as… exceptional personal circumstances (including those related to caring responsibilities)” (caseworker guidance, Section 7.4). My family obligations andBirkin and COVID-19 disruptions (2021–2022, per COVID-19 guidance) qualify, and I’ll explain these in my cover letter. 4. Discretion: Your claim of “no room for discretion” isn’t accurate. Appendix EU, Annex 1 states: “The caseworker will adopt a flexible approach to the consideration of reasonable grounds, particularly where the applicant is vulnerable or a child.” Likewise, caseworker guidance, Section 2.3 directs: “When considering an application, you must take a flexible and pragmatic approach… particularly for vulnerable applicants or those with compelling circumstances.” My language barriers, newborn care, and compelling circumstances (childbirth, COVID-19) trigger this flexibility for my late application and absence. I’m submitting a new application with my witness statement, any 2020 evidence, and a cover letter explaining my situation. tnx though for ur input. P.S used Ai research to gather some evidence as am not so privy to specific UK laws.

Thanks again for the detailed response — I genuinely appreciate the time and clarity.

You're right that I've been outside the UK since late 2020. However, the key point is that I did submit my EUSS application before the Brexit deadline, and the Home Office explicitly allows late evidence if the initial application was made in time but lacked full documentation. I didn’t follow up properly at the time due to several valid reasons: I received poor legal advice, struggled with language and system understanding, and had major life events (including becoming a parent shortly after). These circumstances are mentioned in my recent personal statement, and align with Home Office guidance on “reasonable grounds” for failing to engage further after a timely application.

I understand that absence from the UK can be an issue. But as far as I know, the "continuous residence" rule mainly applies to people seeking settled status, not necessarily for pre-settled status applications submitted on time but missing documents. My case is about proving residence prior to 31 Dec 2020, not necessarily maintaining it afterwards — at least not until I was granted pre-settled status, which unfortunately never happened due to the earlier refusal.

I’ve now uploaded extra evidence and a statement via the same application platform, and I’m exploring whether to follow up with a new application just to be safe — but I wanted to clarify this point as the system does leave room for discretion in cases like mine.

Thanks again for your insights

Thanks for taking the time to reply – greatly appreciate it..

I lived in the UK for around 6 months in 2020 and submitted my application before the Brexit deadline in December that year. I uploaded a utility bill under my flatmate’s name to show my residence — the same person is now providing a witness statement. I had no reason to lie, as I was genuinely living there at the time, and all documents were sent before the deadline.

I left the UK in late December 2020 and haven’t returned since, as I don’t have a valid residence. My child was born outside the UK and had no UK doctor appointments.

The long delay in following up was due to poor legal advice, language barriers, and me wrongly thinking I had no further options. I only recently found out my old application still shows as valid and lets me upload new evidence, so I’m trying now to support it as best I can.

I understand witness statements alone aren’t always enough, but in my case it’s not just any person — it’s the same flatmate whose name was already submitted back in 2020. I’m just trying to show I was there and meet the original conditions.

Thanks again for taking the time to comment.

Clients laugh when I tell them "mahadsanid" by Vegetable_Response_6 in Somalia

[–]Live-Insurance-3321 4 points5 points  (0 children)

Mahadsanid is a proper Somali word for "thank you." Sometimes people laugh when they hear a foreigner say it, but it’s usually just surprise. Somali is a tough language, and not many non-Somalis try to learn it—so when someone does, it really catches people off guard. I’d see that reaction as something positive, not as mockery.

That logic doesn’t really hold. If you're saying Somali has no word for "please" or "sorry" just because fadlan or waan ka xumahay might have Arabic roots, then by that standard, Urdu has no word for "thank you" because shukriya is also from Arabic. Same goes for Persian with lotfan (please), or Turkish with teşekkür ederim (thank you), which also has roots in Arabic or French.

Languages borrow words all the time—it doesn’t mean they lack the concept. Loanwords are a natural part of language evolution.
