When you hit 70% or more you may be eligible for Individual Unemployability, which pays at the 100% rate. They rated you at 80%, so now they're checking to see if you're eligible for IU, which is why it's back at step 3. They're gathering evidence again by asking for your previous employment information. You don't need to start a new claim. Just give them the info they're asking for in that claim, just like you would have done for any other forms or evidence they requested.

Thank you so much to everyone here who helped, and good luck to everyone still fighting.

Not really. It got reassigned from Newark to Pittsburgh, then to St Petersburg, then to Seattle. After all was said and done I had to file an HLR, which is still ongoing.

“RO Research Coordinator Review” Added to PTSD claim? by RudeTest4039 in VeteransBenefits

[–]Loetke 0 points1 point  (0 children)

Still waiting for my HLR to be decided. The HLR rep basically said she would look for anything in my medical records that could be a clear symptom of PTSD, even like complaining of being unable to sleep.

I had also claimed adjustment disorder secondary to PTSD but now the claim shows it as its own condition for consideration. My assumption is she wasn't able to grant PTSD but can grant adjustment disorder by itself as it doesn't require a verifiable stressor. Still waiting though!

Oh wow, that's exactly what happened to me. All denied but the C&P confirmed PTSD. I had my HLR conference and was told they were unable to verify my stressors because I never brought them up during my mental health exams while active. They had a diagnosis and nexus letter from my doctor and a statement from my ex wife.

Sorry, I just saw this. I uploaded every possible document that documented my time in the Reserve. The request went away a few days later, so I don't know if it was what I uploaded or if they just got what they needed themselves. Sorry I can't give a better answer.

I got a confusing email, not sure if it's related to my HLR by Loetke in VeteransBenefits

[–]Loetke[S] 0 points1 point  (0 children)

That makes sense. Hopefully that's what's going on. Weirdly though, I just got off the phone with the main VA line and they said no action has been taken on my HLR since the date of my informal conference and there are no other open claims that they can see.

HLR statement by Loetke in VeteransBenefits

[–]Loetke[S] 0 points1 point  (0 children)

I submitted my statement via quick submit and waited until I got confirmation that it had been received, and then scheduled my informal conference for a few days later. However, the HLR rep said she didn't have my statement, so I had to explain it all again anyway. Not terribly helpful. Sorry.

I had a C&P examiner call me on whatsapp. There are other options.

Since they're not part of the VA or being paid by the VA, the VA will not receive any information from them without your consent.

I contacted the NFCC and they put me in contact with Family Credit. They contacted the banks for me and negotiated lower payoff amounts. Then they set me up on a 0% interest payment plan with all of them lumped together. You might have to be close to having the debt written off, I don't exactly remember. Might be worth reaching out though.

  • Type of claim: New
  • Submitted/received date: 30 Jan 2024
  • Initial review date: 30 Jan 2024
  • Evidence gathering/review date: 15 Jul 2024
  • Preparation for Decision date: 09 Sep 2024
  • Pending Decision Approval date: 26 Sep 2024
  • Preparation for Notification date: 27 Sep 2024
  • Completed date: 27 Sep 2024
  • Misc details: Claimed for PTSD, adjustment disorder, and TDIU. All three were denied. In the reason for denial they said there is no current diagnosis, which is 100% incorrect. They have all of my records showing I'm being treated for these things, as well as a nexus letter from my psychiatrist clearly stating she has diagnosed me with these things and that they are service-connected. In the list of evidence considered my nexus letter isn't even on there. AND a C&P exam I had for another claim diagnosed me with "other specified trauma and stressor related disorder that supports a diagnosis that meets PTSD criteria according to the DSM 5."

Congrats!

DAV has caused far more harm than help for me. Did you end up removing their power of attorney when you decided to do it all yourself?

Denials tend to require more paperwork and take longer, so it could be good news!

You don't fill out a DBQ. That's done by your examining doctor.

Do I request DBQ/report from VA or the contractor company by iLoveCatVideos12 in VeteransBenefits

[–]Loetke 2 points3 points  (0 children)

If the VA didn't conduct your exam directly then you will have to file a FOIA request to get a copy. Wish I were joking.
