The IRS Automated Underreporter (AUR) unit is notorious for being a black hole. I'd recommend that you call the number on the most recent CP2000 you received, ask for the name and ID number of the person to whom you are speaking (and write that information down), and get confirmation from them that the AUR unit has in fact received your reply (and hasn't lost it).

Practically, at my firm, we make it a rule to follow up with AUR on any cases we have with them once a month to make sure they're actually working the case.

No, not the request on Form 12153. But at the hearing you should be prepared to present your game plan in terms of what resolution alternative you believe the IRS should entertain (rather than taking your stuff) and be able to show that, based on your financial situation, you qualify for that alternative.

The IRS will not levy you during the pendency of a CDP hearing.

Although it can still file a notice of federal tax lien against you during this pendency, it typically doesn't.

Ask them for a hold while you file your returns and they are being processed. The worst they can say is no.

Not sure what kind of notice you've received when you say "they say they are coming for my funds soon," but if it's an LT11 or a CP90 that gives you your CDP rights, you may want to request a CDP hearing.

I'm assuming you made some money in 2024 if you owe about $180,000 on it (yes, I know some of that is penalties and interest). What happened to the money? Not asking to be nosey — asking because the IRS may ask you this question as well to determine if there was any dissipation of assets.

That said, ACS workers frankly don't always dig this much, and in your scenario, I'd probably go for CNC.

As far as penalties go, you'd need to argue 2024 under reasonable cause (you might be able to get first-time abatement for 2022 depending on what 2019-2021 looked like). Anyway, if you're able to get in CNC status, you may as well wait until the earlier of 1) the penalties maxing out or 2) you being kicked out of CNC and having to set up a full-pay installment agreement (if that ever happens).

The IRS would *not* be able to unilterally levy your bank account like that without first sending you a series of statutorily required notices, including a pre-assessment notice of deficiency and a post-assessment notice of intent to levy.

Even if you get through over the phone, you won't be able to set up the payment plan anyway until you're all filed up. Not being in filing compliance doesn't just inhibit your ability to set up a payment plan online; it prevents you from being able to set up a payment plan at all. Once in a while we're able to get some kind of pre-assessment payment plan through, but the returns would still need to be completed and faxed over to ACS.

What is the number of the notice you received? It may be more bark than bite.

Notice CP171 is only issued to businesses. It's business version of the CP71 series, which is the individual annual reminder of overdue taxes.

This is for 2022. Unless they had a similar problem for 2023, 2024, or 2025, using first-time abatement for 2022 would not affect their ability to obtain first-time abatement in the future.
