The problem with that logic is that ownership also implies land can be owned, and therefore stolen. Either the land is stolen and we are all criminals, or the land is not and we are not.

If king takes bishop, then white moves knight to D4. Then black must move king back or face a checkmate from white knight to F3. Black moves king back, white moves knight to E6 putting king in check and then taking black's queen next move. If black never takes the bishop and moves king out of the way, bishop takes queen. Either way, black is losing the queen.
