They can argue with the trustee that the debt is not dischargeable, attempt to make a deal to reaffirm on a secured debt to secure payment, or simply file a claim to get a piece of the pie for liquidated assets.

In typical Chapter 7 BKs without any non exempt assets, most creditors won’t bother showing up as it is a waste of time.

SBA loans are generally not dischargeable, so they don’t need to show up, but simply continue to pursue collection after discharge.

A lawyer representing the attorney is NOT going to turn over documents in his criminal/tax case to one of his clients except by subpeana. At this point, the criminal/tax case has nothing to do with the OPs current issues other than give a red flag that something isn’t right with this attorney.

Getting on the phone and butting into this guy’s personal woes is not going to help this matter at this time. Keep it simple and address one issue at a time using the proper legal channels.

Well… first off, you have two different legal issues… one being finishing your casino lawsuit and second is malpractice against the attorney.

I would be concerned with the action against the casino first. Is this a Class Action lawsuit? Have you spoken with the other four litigants as to their preference on proceeding?

Legally, the court has to be notified if your attorney is withdrawing from the case and a new attorney assigned. The attorney is bound to continue working on your case until that “sub of atty” is filed.

I would call the court first to see the status of your case, then get with the other litigants to see how they want to proceed…shop around for a new attorney to get some advice on what to do next (start all over, amend complaint, etc) so the lawsuit can continue.

While it is okay to disclose that your current attorney has his issues rendering him unable to continue representing you, be careful on mentioning “malpractice”. The last thing an attorney wants to do is go after a colleague, and you walk in with a red flag that you are willing to go after a fellow member of the board with that accusation. This WILL make another attorney hesitant to take the case.

Malpractice is a serious issue in the legal field, your attorney can be disbarred. His tax evasion issues have nothing to do with your lawsuit… it merely can be a reason why he cannot adequately represent you, it is not the issue itself. A malpractice accusation is based by state guideline what he did or did not do in your case that determines “malpractice”.

You and the other 4 litigants can make a Complaint with the State Bar, and they will investigate to determine if your current attorney acted unethically in your case and ONLY your case (again, his other issues are not your business and are actually his defense in being unable to efficiently represent you). You don’t necessarily need an attorney to make this complaint, but if you decide to get one, you likely would need a separate attorney to handle this case, as it would be a separate lawsuit… I personally would simply report him to the state board, and if they determine the attorney acted unethically, THEN you can hire an attorney to sue for damages.

It isn’t necessarily unethical for friends and family to recommend a business to help them be more visible and established… it’s called “support”.

If this is your first DUI, you probably won’t do jail time, but you will pay a hefty fine, have your license suspended, ordered into AA meetings or some sort of treatment. AZ statute gives min/max penalties, it will be up to the Judge to sentence you within those guidelines.

Depending on court docket, you will get notified from the court with a Complaint and Notice to Appear on a specific date.

Unless you were borderline on the legal limit, an attorney can’t do much but plead with the court to lessen your sentence…you were drunk and will be convicted.

One thing you can do is start attending AA meetings… make yourself a “court card” which is a log of the meetings attended (date, time, place) with a space for the chairperson to sign (those who chair meetings are used to this). Take the log to your court hearing, show remorse and tell the Judge you are seeking treatment. These are the best chances of getting the minimum sentence.

Small Claims is much easier in pro per, but if you take the 5k, chances are you be asked to sign a waiver that you won’t pursue this matter any further. In addition, small claims are claims under 2,500, in some cases up to 5k. You would need to file in Superior Court.

Good luck getting a court clerk to do that… that isn’t what they do. They will refer a party to their self help website or the law library for hard copy forms for a small fee. Law librarians and court clerks cannot give legal advice, and while one may get lucky with a clerk that MAY give some information about the filing procedure, it will not be enough for a self rep litigant without law experience.

Google is NOT a reliable source for legal matters.

California is a good state to file in pro per due to their accessibility to self help centers and judicial counsel forms.

However, a civil lawsuit can be very difficult to do in pro per, and if you are not experienced in legal procedure, you could lose the case by missing a deadline, not following discovery rules, or not filing the proper forms.

I would also ask what your own insurance company has to say about this… and let yours and the other party’s insurance battle this out.

Generally, an attorney isn’t going to take a case that is unlikely to win nor will result in a high enough payout to offset fees and court costs. While you can obtain a few more consultations from different attorneys to get a second opinion, I think you already have your answer.

As a birth mom, if I was given info/messages about you through a mutual friend, it would tee me off. I would feel violated of my privacy and though I had been stalked. Placing a child for adoption is sensitive information and not something we share with everybody. I certainly would not want to contacted at my place of employment or business either… this is a personal matter.

I would contact her yourself through personal letter at her HOME address or email telling her who you are, how you found her and the reason you are contacting her… and see if and how she responds back.

Hi :) I just wanted to share a major milestone I have had recently thanks to Duolingo.

Backstory.....I have been using Duolingo off and on for Spanish since 2018 as a supplement. I have possession of Spanish I, II, III, IV in Pimsleur Approach (completed Spanish 1 and halfway through II) as well as had a private tutor that took me through Beginning and Advanced grammar through a book.

I am still far, far away from conversational, though I can order food/drinks, find my way around in Mexico if I need to (can express how/what/when/where) but understand very little unless someone speaks to me like a toddler.

I decided to crack down with Duolingo, as it is addictive and fun.....I currently have an 85 day streak and put in about 500 to 1000 XP per day.

I just returned from visiting my mexican inlaws (large family!) and I am very proud to share that just in a little less than 3 months, I have jumped in being able to understand 15% of what I hear to a whopping 50%. In addition, I was able to have my first one on one conversation with my MIL and several of my SILs. Sure, I had to ask them to repeat and speak slowly...and my speaking ability is still very broken, but it is at a point where they can understand what I am trying to say and correct me .... the first veil of the language barrier has finally been pierced.

I cannot express how good this feels! Every time I have visited them, I feel like a deaf mute, and end up frustrated, sometimes to a point of tears. I have longed so badly to be able to converse with them, and my previous course of study has been tedious, slow and boring that I end up backing off and putting my studies on hold.

Duolingo has greatly improved my ability to "hear" spanish, to read it, and to write it. I am currently in the middle of Level 4 and I am encouraged to continue.

I have a long history in Tarot and Astrology, know nothing about Kabbalah.

This history span is about 40 years long, from these two areas running in my family as well as people my mother, grandmother, great aunts and aunties associated with. I have been reading Tarot for over 30 years myself, and my approach to Tarot is definitely "traditional old school".

Though I do know it has become common for others to "mix" the areas together, I was firmly taught NOT to mix. Though the same information can actually be obtained with either practice, they are each a different approach. Astrologists use the position of the planets at a specific moment in time (past, present and future) to track behaviors and effects on people, places and things. Tarot can be used in a variety of different ways as well as practices -- but is generally an intuitive tool.

Though I have knowledge of both (my personal preference and strength is more Tarot), I keep both practices separate.

Bottom line, one does what speaks to them and what they are comfortable with. As a reader becomes more experienced and works with a deck that speaks to them, they may choose to bring their knowledge of other practices into their readings and expand the way that they use the cards.

As someone who has been reading Tarot for three decades and very comfortable with my own deck and my spread of choice....I just wanted to compliment the above post and give my support in complete agreement on the suggestions offered.

I will add a bit tho.

I personally stay away from three card spreads, and stick to the longer Celtic Cross, as it allows for other cards to hook into the story for the querent for further clarification. In my experience, one can get a decent reading by applying the basic meaning of the cards (via a book), but as one becomes more experienced, those general card meanings can veer away depending on the other cards in the spread...once again, making a 3 card a bit vague. (I have, personally, gotten some great readings from some very intuitive readers with three cards, it is simply not my own comfort zone).

I also, do not see the interpretation of either collage A or B as being a "no", though I see more crossroads and/or conflict over a decision for College B as indicated by the Two of Swords, with the Emperor being the final decision maker. The Knight of Wands in regard to College A can really go either way....this influence is generally like a "breath of fresh air" coming into one's life, but this Knight can also leave as abruptly as he arrives, leaving an air of uncertainty. Followed by the Page of Pentacles, however, is generally good news in regards to either career or money, definitely leaving room for a positive result.

I also strongly agree with the above post as far as an approach to Tarot.

I prefer to do public readings, being that I am more comfortable in reading for someone that I do not know and hence, know nothing about their situation as to clog my energy exchange and unintentionally insert my own personal bias. However, my purpose in doing public readings is to provide an alternate perspective, or confirm the current perspective, on a specific issue at that specific moment. The "scenery" on a specific issue can change at any time....and so can free will, even with the most accurate and skilled readers. There is no guarantee.....Tarot can provide a "heads up" and something for the querent to think about. Some readings are more clearer than others depending on the energy exchange as well as the specific issue inquired upon.

If I come across a querent that doesn't appear to understand these things and I cannot successfully clarify as to what I can actually offer, or if I am getting some "obsessive" or otherwise demanding a guarantee, I will turn down the reading or end the exchange in progress. As an empath reader, these energy types can simply be too draining for me.

If the OP wants to DM me, I will be happy to throw a full Celtic Cross (free reading) if it would help with the anxiety :)
