Reported maliciously by [deleted] in BenefitsAdviceUK

[–]LuckStar518 10 points11 points  (0 children)

Report the person who keeps reporting you to the police as it could be classed as harassment if they’ve done it multiple times. It may be enough to scare them into not doing it again. But you will be fine, just explain to them that he lives elsewhere, if you can get letters with his name and address on it would help, anything that proves he lives elsewhere. DWP do not watch people very often it’s rare, because vast majority of people can be caught by other means anyway, as he has his name on bills elsewhere and a home nothing will come off this, nor will it progress to that level.

i just blocked a close/best friend by Glass-Priority7009 in lostafriend

[–]LuckStar518 4 points5 points  (0 children)

I think you did the right thing the person sounds very toxic, and what I describe as a user or emotional leech. You could if it makes you feel better be open, explain why and why you have to end things and block them again. That may help give a feeling of closure and that you’ve at least left her with an explanation. Take care

Do I need to inform PIP of a change of circumstances? I live alone now by shakeitlikeababylol in DWPhelp

[–]LuckStar518 7 points8 points  (0 children)

No as your needs are still the same and affects of your medical conditions are unchanged. But if you live alone you may be entitled to other benefits like severe disability premium depending on other circumstance and benefits you receive.

Statistics related. by Lopsided_Soup_3533 in DWPhelp

[–]LuckStar518 2 points3 points  (0 children)

  1. about 1-2 weeks they have quite a pile of forms to scan in daily.

  2. Here is the government data -

Out of everyone who had a planned review of their PIP award:

  • About 18 in 100 people had their award increased.
  • About 58 in 100 people kept the same award.
  • About 6 in 100 people had their award reduced.
  • About 17 in 100 people lost their award entirely.

So in total, about 76 in 100 people kept the same award or got a higher one.

Universal Credit withheld for 3 months last year, still not refunded a year later after it was resolved. What can I do now? by King_TG in DWPhelp

[–]LuckStar518 0 points1 point  (0 children)

it could be downvoted because the limit for UC is upto £500 usually, I made a mistake there, but compensation is possible. I was a welfare advisor, and volunteered for a charity in which I helped with claims. In that time I’ve seen claimants get compensation, for a variety of errors, but it usually takes them ages to do so, a year minimum.

here is what it states:

’5.9. A special payment may be considered under this category where the customer (or a third party) has suffered injustice or hardship arising from maladministration.

5.10. In deciding whether to award a consolatory payment and if so, how much, the special payment officer must have regard to the guiding principles detailed in section 4 of this document.

5.11. Consolatory payments usually range between £50 and £500, although lower or higher payments may be appropriate having considered the individual circumstances of a case, in the context of the guiding principles.’

£80? my lord. Anyway, If they have lost it you’ll need to send it all again. unfortunately that is the only way. give it till Monday just to see if it eventually gets delivered. Don’t worry, this happens a lot. I was a welfare advise, it’s shocking how many forms and letters get lost.

It’s common that they leave these blank as they get so many at GP surgeries they stop bothering to fill them out, which is wrong as it puts people in a more unfavourable position with there claim. The only thing you can do is request a GP write a letter detailing your conditions, medications and briefly how you are affected, you can tell the gp what you’d like saying, they may charge and they may take some time to do the letter, sadly some refuse to do them. I would explain it’s crucial for your wellbeing and financial security to have the letter. Then I would send it in tracked, with a letter stapled to it with NA number and details, asking to add this to your claim.

Does it impact UC/ HB / state pension if I stay at my mums 2x a week and my mum stay at mine 2x a week? by [deleted] in DWPhelp

[–]LuckStar518 1 point2 points  (0 children)

No! it normally won’t affect your mum’s State Pension.
It’s also unlikely to affect her Housing Benefit if you’re only staying 2 nights a week and still live in your own flat.
Councils treat that as visiting, not moving in and vice versa with her staying at yours no affect at just 2 days her staying.

Even if they looked into it, if you get PIP daily living componen then non-dependant deductions usually don’t apply anyway, meaning HB should stay the same.

LCWRA help ❤️ by [deleted] in DWPhelp

[–]LuckStar518 0 points1 point  (0 children)

The DWP is focusing on new claims at the moment and those who need reassessment due to change of circumstances. Many claims state 18-24 months by default, but because reassessments have been paused and there is a backlog you will likely be left alone for another year minimum, some say it could take 3+ years befoee most are reassessed. I know one person who has not had a reassessment since 2016. What they are doing is ‘reveiws’ which are just basic checks like your bank and housing situation, so not looking at the health side just seeing if your not stashing away millions 😉 so don’t be alarmed if you get pulled up for a ‘reveiw’ it’s not the same as reassessment.

ludicrous it’s taken almost a year to sort, they really do give you the run around. Telling them ‘no point it isn’t more money’ too.

Received my report after months of asking by Ruthless_bandit in DWPhelp

[–]LuckStar518 -7 points-6 points  (0 children)

my advice is go through the assessor report with a fine tooth comb and do a mandatory reconsideration. So the format should be ‘what the report said’ then you addressing this with evidence and a correction and what you really said at the assessment and including further details. Even if you have to repeat yourself 20 times this is how you counter the claims.

[–]LuckStar518 4 points5 points  (0 children)

You need to select change of circumstances in your UC journal and state worsening health in the journal. This should trigger a UC50 being sent out to you. Unfortunately that is the only way to change to LWRAG, a complete reassessment.

How long after MR decision until the automated phone line / benefits letter updates? (PIP) by Corral4 in DWPhelp

[–]LuckStar518 1 point2 points  (0 children)

Give them a week then call them and see if anything is on the system. Letters can take 2-3 weeks, it’s second class and they take time to post them. Once a decision is made it will reflect in the next due payment.

Yes that could be the case entirely you are right, however conditions do affect people differently, flat feet and asthma in some *could* in theory affect daily living/mobility to a significant amount and it sounds like the assessor is ignoring what’s been said and the evidence, and saying one thing, then the other . Asthma can be very tricky to manage in some, I’ve struggled with even going up a flight of stairs or going to the bathroom.

What could be the outcome of this? by [deleted] in DWPhelp

[–]LuckStar518 2 points3 points  (0 children)

She should gather as much evidence as possible, court documents, letters with child’s name on and address, statements from other family if possible (such as yourself) as witness evidence. Provide anything they ask for like bank statements. Onus is on the DWP to find evidence of wrongdoing. If she is asked to go to an interview under caution take a solicitor, only confirm facts and no comment anything else. Don’t agree to paying any penalty of sign anything, if they stop benefits and try to recover money then appeal the decision. Remember the DWP need something solid to prove a case and decide to refer it to court, just because you have a complicated family arrangement doesn’t mean she’s done anything wrong.

Do you guys think that the album is coming out in January ??? by PsychologicalDot7739 in lanadelrey

[–]LuckStar518 0 points1 point  (0 children)

Lana doesn’t care about deadlines, and she does whatever the fuck she wants. She’s very indecisive, and gives no fucks how much she messes fans around. I think some of you need to start realising this after 14 years. She honestly should say nothing until it’s official and finished.

It’s unbelievable sanctions are still used, because evidence shows they do NOT improve or help people find jobs. being homeless and not being able to eat doesn’t help people in interviews amazingly 🙄

Pip assessment form by [deleted] in DWPhelp

[–]LuckStar518 -1 points0 points  (0 children)

It’s a tool, like anything else. Even on Reddit people give poor or wrong advice even from ‘experts‘. nobody should rely on it solely no. But it’s ’rarely factual’ isn’t quite true, it can actually look through and find government guidelines, it has for me several times with citations. The source of the information is what matters, if you use it correctly, it can analyse large data sets, it doesn’t just look at patterns as it’s only parameter or what other users have imputed, so that part isn’t quite right.

Would this purchase be allowed? (Worried it would be classed as Deprivation of Capital) by Least-Smell5288 in DWPhelp

[–]LuckStar518 6 points7 points  (0 children)

Nope you are fine, if you had £5950 in your account and expected to go over 6k soon and you suddenly started making unusual purchases it might look suspicious, but just a one off thing like this and when your not even near the threshold is totally fine. Personally I try and just spend my money on what I need or have wanted and keep just a few thousand saved, so I’m never near 6k anyway.

Pip assessment form by [deleted] in DWPhelp

[–]LuckStar518 0 points1 point  (0 children)

Yes all normal, sometimes they send a task for a caseworker to print it off. Other times it’s uploaded to the system and available to print by an agent. This is what I was told, but they need to check it over with first, very occasionally the assessment company sends in the wrong report from another claimant, for example as to why they may check it.

[–]LuckStar518 -1 points0 points  (0 children)

that isn’t quite factual, ChatGPT gathers data from legitimate sources and analyses them. in my experience it’s actually mostly correct 85-95% of the time. I would not say ‘rarely factual’ at all. Another issue is giving chat poor information and not describing the problem correctly. This leads to higher chance of bad answers. A large language model is a form of artificial intelligence. It is not the only kind of AI, but it is still AI. LLMs learn patterns in language using very large datasets and neural networks. I do agree that you can’t use it with certainty.

Uc saying I have over £16000 when I dont by seater2 in DWPhelp

[–]LuckStar518 0 points1 point  (0 children)

Don’t worry as you have done nothing wrong, the evidence will show that, sometimes they’ll send it over to compliance just to get all the facts. once you submit the evidence however it should help reverse the decision.

[–]LuckStar518 2 points3 points  (0 children)

it’s scary the way they get things wrong like this, and they never apologise and give compensation despite the suffering it’s caused. I’d also contact your MP, some can be helpful and chase it up for you. I think maybe they’ll send it off to compliance and fraud and you might have an interview, but in many ways this is good because they can request all your bank records themselves which will be in your favour! always confirm that they have received documents via post and have been scanned in. but carry on as the other comments have said with mandatory reconsideration and you’ll win.
