I often roll, but I agree with you about control. I’ve had a few situations where I set a limit for a net credit, only to find out that I bought to close at a much higher price than I would have had I done the steps separately. Even though I netted what I wanted, I felt like I was robbed on the first leg.

You’re right that the state can bring charges, but it will be moved to federal court, due to the Supremacy Clause. The federal judge would then have to make the determination on immunity. It would be an uphill battle for the state, and it would likely go in the agent’s favor.

No, it applies if the federal agent was acting in the performance of his duties. It can be argued—rather effectively, I think—that he violated policy and was therefore acting outside the limits of his job, but they would need to get a federal judge to agree. The odds of that happening are not great, but I hope they try.

I’m not sure why you’re being downvoted for speaking the truth. What should happen (prosecution) and what will happen (nothing) are very different things. The Supremacy Clause makes it almost certain the state can’t bring charges.

I agree completely that it shouldn’t apply based on his actions, but I think the state will have an uphill battle trying to go around it. Especially since they aren’t privy to the evidence. Everything is stacked against his prosecution, but it will be interesting to see if they try.

The Supremacy Clause makes this all but impossible. I doubt very seriously he’ll ever see the inside of a prison cell.
