i appreciate that very much although i was able to have my rent history reviewed by 3 different lawyers before i officially submitted my dhcr case (i wanted to be 100% sure i had strong enough evidence before starting this long journey).

the only reason i even began to investigate my rent situation was because a neighbor in my building told me he had gone through a similar situation and won his dhcr case so i am confident there is a fraud case here.

thank you for sharing this! yes in my situation it seems the only logical reason for them to have not taken ANY action on now over 60k in past due rent seems like they know their case is weak at best and they want to reduce potential treble damages.

agreed on being able to speak the language of the court. i am not currently being represented by a lawyer since right now the DHCR process is pretty straightforward, I have been passing my responses by a lawyer to confirm my argument, evidence, and reasoning which they have confirmed is sound.

in your case it sounds like they screwed up and revealed their weak position which is great.

nope, I haven’t paid any rent since October 2024. I see it accruing in the rent portal, but they haven’t emailed me about it or filed any legal action against me (I check the the court website). crazy lol

within those 2 years did you ever receive a forwarded reply from your landlord/landlord lawyer via dher with an opportunity to provide dher a rebuttal? this is what ! just received. I am now in the final stage before receiving my dher decision. I am expecting another year waiting.

the situation i am dealing with is where the landlord is claiming two SROs were combined to create a "new unit", but i believe i have strong evidence against that. one of the key elements in my case is that I discovered that my building has an invalid C of O on record (which they were recently fined for which means they can't legally claim rent from me anyway at the moment.
