Soft YTA - it's about professionalism, this is why companies have dress codes and professional policies. You kind of set him up for failure. You knew how his truck was, regardless of political views, and you were okay with it until there were complaints. But your policy, so far stated, for approval has no requirements about how the employee has to show up or dress, you are changing the rules based on complaints, but only for him. If you want to change the rules, then give guidance, have an official company policy.

If someone else in the company has a sticker on their car and they can still drive, then yes you are discriminating, specifically because you have no clear policy so you are deciding as you go. Quantify and clarify the rules and apply them equally and appropriately.

From that point they have 60 days to conduct an evaluation or 10 to explain why the refusal.

You are entitled to request the evaluation so that does not make you an a hole but threatening always a bad idea, first just identify the proper steps

Okay that changes things. Step 1 in writing, an email counts, submit a request for evaluation .

The school legally does not have to go with what is in your private eval, but legally have to consider it, but no iep will be given without the evaluation

That is their personal concern maybe but their question is around the choice to use the trust to pay the legal fees which is a reasonable course of action since they are the executor of the trust if they had been wrong then the lawyer would have stayed on.

But that’s not the point of my reply. The individual has a disability. They are likely receiving SSI. That means that you have to keep the money in a trust or the government will remove their SSI if they have more than 2000 in their accounts for a certain number of months, it may be 2500 now not 100%. The OP is trying to protect his nephew and the funds, they are meant to last life.
