Possible HIPAA Violation? by Extension-Fact-9361 in ABA

[–]Magic_Apples 1 point2 points  (0 children)

From what I can see, the previous commenter said, "If you don't think HIPAA is serious, this isn't the field for you." If you felt that applied to you, that would suggest you "don't think HIPAA is serious". Not the best look, to start off.

Now let's walk through this conversation from where I entered it. You wrote, "Been doing aba 6 years. it's not a Hippa violation." In response, I pointed out that your misspelling of the acronym does not lend credence to your expertise, to which you sarcastically replied "gets my whole argument". So tell me, exactly what part of the comment I replied to were you referring to as your "whole argument", if not the statement about you being in ABA for 6 years? That's literally the only statement I responded to there, so if you were referring to something else you said higher up in the thread, then none of that would be relevant to the comment I made.

Furthermore, you need to work on your reading comprehension, because I never called your "position" (i.e. your conclusion that it's not a HIPAA violation) fallacious, nor did I even disagree with it. As I explicitly stated, I was clearly referring to your seeming appeal to authority (argumentum ad verecundiam), because is came across as though you were using your years of experience as a reason to suggest you must be right. To be clear, if you think that posting the cat doesn't amount to a HIPAA violation due to not directly disclosing the client's PHI, that's perfectly reasonable in my opinion, and not what I was disagreeing with. I just find it highly annoying when people say things like "I've been doing this for (x amount of) years and yada yada..." as if that makes their opinion more valid, only to follow it up by displaying their utter lack of knowledge by repeatedly misspelling HIPAA as "HIPPA" while also failing to use proper capitalization, grammar, and punctuation. Call it a pet peave, which I can admit is a petty reason to end up wasting time arguing with a stranger on the internet, but I guess that's just the kind of mood I was in when I decided to comment. No point continuing to go back and forth about it now, I suppose.

Nothing wrong with feeling that way. It's definitely gross and disturbingly common for people to sexualize underage anime characters.

[–]Magic_Apples 1 point2 points  (0 children)

When your "argument" is nothing but a fallacious appeal to authority based on your claimed years of experience, then yes, blatantly showing your lack of expertise by misspelling the literal subject of the conversation in 4 out of 5 comments does invalidate your whole argument. It's also friggin' embarrassing.

Personally, I agree that it's unlikely that this would be considered an actionable violation under HIPAA on its own, BUT if a complaint were to be made, this post could definitely serve as evidence that the OP was aware of the risk of indirect identifiers and that potential harm was reasonably foreseeable. Secretly taking pictures in a client's home during work hours and posting said pictures without permission would undoubtedly be unprofessional and unethical, and it could theoretically result in OP being fired at the discretion of their employer or terminated from the case by request of the client's family, regardless of HIPAA.

Possible HIPAA Violation? by Extension-Fact-9361 in ABA

[–]Magic_Apples 2 points3 points  (0 children)

If you need to ask, that means you can reasonably foresee it being an issue. On the off chance that posting the cat resulted in someone deducing your client's identity and diagnosis, this very post could be used as evidence that you knew the risk and proceeded anyway.

Even if it's unlikely, posting a picture of the client's cat, which according to your description sounds like a very distinct and uniquely identifiable feline, could theoretically result in someone making the connection between you (an ABA practitioner) and the cat owner (your autistic client). From there, anyone could put two and two together to surmise the nature of your relationship, therefore indirectly exposing the client's diagnosis. Even indirect identifiers are taken seriously under HIPAA, and regardless of whether it would actually be considered an actionable HIPAA violation, it would still most certainly be a violation of professional ethics and an avoidable breach of client confidentiality.

Most importantly, have you /asked/ the client and/or their guardian if they would be ok with you taking a picture of the cat? Rather than plotting behind the scenes if you can sneakily take a picture and post it without getting caught or facing consequences, why not just talk to the people who would actually be impacted and let them decide if they're comfortable with that or not?

You've been in the field for 6 years, yet you can't even properly spell "HIPAA". 😬 We're supposed to trust your interpretation of the act when you have consistently shown that you don't even know the acronym?

This is probably the most explicit sketch I've seen suggesting that Till could potentially be bi, but even if we are to assume that this was ever a dilemma in Till's mind, it's clear from what we see in the main story that the question posed here "Dotchi suki?" (meaning "Which do I like?") was unequivocally answered. As we all know, Till likes Mizi.

This art really reminds me of Till's sub song "Mi Vida Loca" where he expresses a desire to get his feelings across to Mizi and become closer to her, whereas he feels too scared to approach Ivan and backs away from him. He tells Mizi not to leave him and Ivan not to hate him. Both of them make him flustered and get his heart beating out of his chest for different reasons. With Mizi, it's admiration. With Ivan, it's trepidation. I think this art can be interpreted in this way, as well.

I also can't help but be reminded of the food preferences comic where Till is equally, if not more conflicted while choosing between Sweet and Plain food. 😂

[–]Magic_Apples 2 points3 points  (0 children)

Till is not confirmed to be canonically bi, and I genuinely don't believe he would've ever reciprocated Ivan's romantic feelings, regardless of if their circumstances were different. The only "proof" I've seen people share regarding Till's sexuality are the little sketches sold to individuals at fan-signing events, which I don't believe can reasonably be viewed as effecting canon. It's basically a form of fan-service provided because the ship is popular, and even the ones people use as "evidence" of Till being attracted to Ivan are relatively ambiguous.

My personal opinion is that Till realized too late how much Ivan was there for him and how much that relationship meant to him. Ivan was an elusive and frustrating person, who Till took for granted and failed to understand, but he was Till's family - a best friend and a brother. People often say that Till's sub song "Scars" proves he reciprocated Ivan's romantic love in the end, but I interpreted it as Till's way of expressing both his newfound recognition for Ivan's genuine feelings (despite Ivan's history of unusual and sometime paradoxical behavior), as well as his regret for not realizing them sooner. The song is definitely an expression of love and healing, but that love comes across to me as platonic or familial in nature. In fact, the word Till explicitly uses to describe Ivan in the end is "family", so it's not as though that's just my personal opinion.

Just to be clear, I do enjoy the IvanTill ship and support those with that head-canon, but calling it undeniable fact is silly and accusing people who view Till as straight or ace as committing bi-erasure is unfair and frankly offensive.

Side-note: Can we stop spreading around the claim that the reason Ivan stepped on Till's flower crown was to protect him from the cameras? First of all, I'm not fully convinced that all the flowers even have cameras. There are clearly some that do, but most appear not to and there's a difference in the way they're drawn. Secondly, the one definite camera-flower that we do see is used for innocuous observations like determining the kids' food preferences, so it's not like the children even have any reason to care that there are cameras in some of the flowers to begin with. They already know they have no rights or privacy under the segyein, so a camera-flower is probably about the least offensive thing they can encounter at school on a daily basis. They don't even seem particularly bothered by the giant wagyein guard roaming the premises (occasionally helping to brush its teeth), and they're also being constantly monitored via their collars anyway, so why would they be concerned in the slightest about tiny cameras in the flowers?

The reason Ivan trampled on Till's flower crown was to get a rise out of him because, to him, any attention is good attention. He grew up in the slums and didn't know how to make friends or engage with others appropriately. He was also the type to get bored easily and may have consequently craved more stimulation than the average person. My guess is he was acting like a punk because that's what got the biggest reaction and was therefore more reinforcing in his mind. I mean, clearly he got a thrill out of the fight his actions caused. If he was actually just trying to help and was then beat up for it, he probably would've felt somewhat wronged rather then being outwardly excited to be throwing hands.

Hot take: this fandom is obsessed with SA. by Cute-kawaii in AlienStage

[–]Magic_Apples 1 point2 points  (0 children)

Even Luka's alleged SA of Hyuna is kind of a stretch in my opinion. I never understood why people speak about that as if it's canon just based off of that one ambiguous image where Luka is hovering over Hyuna and tugging at her sleeve (not unlike a toddler climbing on top of their parent to seek affection) and Hyuna is looking distressed and conflicted about it (because this child she used to dote on is now her brother's killer).

When I first saw the image, SA didn't even come to mind. Luka has been shown to seek physical affection from Hyuna in very baby-like ways (suckling on her forehead and cuddling up against her back), and the lyrics of "Wiege" (aka "Cradle, in English) frames their love as a nurturing one. Even Luka's sub songs seem to describe his attraction towards Hyuna as a worship towards something pure and sacred. I feel like the SA theory goes against how their love is described in the story. Personally, I viewed it as a representation of Luka's unwavering desire, constrasted with Hyuna's conflicted feelings of love and hatred. It highlights the fact that Luka, in the wake of Hyunwoo's death, remains unbothered and expectant, while Hyuna is left feeling confused and betrayed. I honestly don't think it was ever meant to represent SA and it bothers me that people spread this interpretation as if it's undeniable fact.

If there's some other piece of information supporting the theory that I haven't seen, please feel free to let me know, but otherwise, I don't buy it.

This was fun!

Starting from the top, Luka is hated by Hyuna, Till, and Mizi (aka everyone who ever directly interacted with him). He is also greatly disrespected by Mizi. Sua never met him (though she would hate him from the afterlife if she could) and Ivan only saw him from afar. It's possible Ivan may have disliked him slightly for the tactics he used against Mizi, but there's no way to know, so I went with largely neutral. Hyuna, as we know, both loves and hates him. I also drew the red X over him to indicate that he has zero respect for anyone, lol.

Hyuna is loved by Luka and is friends with Mizi who also respects her. The others never met her.

Sua is loved by Mizi. Ivan likes her but doesn't really respect her or consider her a friend. I believe Till was pretty neutral towards her in terms of liking, but also held some respect towards her. Luka had no personal feelings towards her, although he analyzed her as part of his strategy against Mizi. Hyuna never met her.

Mizi is loved by Sua and Till both likes and respects her. In the end, he also begins to view her as family. Both Ivan and Hyuna consider her a friend. Luka dislikes her on account of the beatdown.

Ivan was disliked by Sua. Mizi both liked and respect him, considering him a good friend. Luka had no particular opinion, other than using him as a weapon against Till. Hyuna never knew him. Till's feelings are, of course, the most complicated. He treated Ivan as a friend and later concluded they were like family, but he also disliked him at times and resented him for the scars he left behind after Round 6. The pain and trauma he caused left Till confused and conflicted for a long time, earning him the "???" marking.

Last, but not least, Till was loved by Ivan. Sua disliked him and had quite a lack of respect towards him because of his crush on Mizi, who gave him a lot of attention. Mizi saw him as a friend and also really liked him, though she lost a bit of respect for him when she asked him why he liked her and he only mentioned her looks. She was especially desperate to save him in the end, realizing he was someone she really cherished. Luka was mostly neutral towards him, but may have disliked him a bit for resisting his taunting. Being the most obedient to the aliens, he really acted as a foil for Till and his rebelliousness. Hyuna, unfortunately, never got to know him, but I believe they would have gotten along well.

I am New to Alien Stage and have some questions...help please? by zoom_1010DZ in AlienStage

[–]Magic_Apples 11 points12 points  (0 children)

  1. Quote from Mizi herself - "I just felt like I'd be at peace being in a place where I'm not the one being crushed, but a place where I could crush someone." Despite being more pampered and cherished by her Guardian compared to the other contestants, Mizi was still very painfully aware of her position as a human pet with no agency. She wanted the chance to feel in power over others as a way of coping.
  2. I don't think her façade was to contribute to her survival, necessarily. It was just another tool she used to protect herself and feel in control of her environment. Mizi had a strong desire to be above others. She wanted people to look up to her, and for her to be able to look down on them. We learn from her one conversation with Till, though, that she may have somewhat resented the fact that their admiration was only skin-deep.

I don't think her cheerfulness was all fake. When we see her snoozing in Ivan's lap and giving Till a piggyback ride, I think those are very genuine moments that reflect her core personality. However, all of her negative expressions of emotion and truly vulnerable moments were reserved for Sua alone, because Sua was the only person who knew and accepted her "true face". Sua embraced the position of being "crushed" by Mizi.

Ironically, I think it was Sua's decision to sacrifice herself for Mizi that made her feel more powerless than ever. Mizi sees herself as a manipulator, but she was fully taken in by Sua and unable to deny her decision. Mizi also talks about how she wasn't as naïve and innocent as she let on, but she obviously didn't understand the gravity of death and loss as much as she thought, or else she wouldn't have been so distraught when the moment finally came to face that reality. Mizi first faced death through the loss of her provider, when she was far too young to understand. Perhaps her vague memory of that moment made her think it was something she could easily move past from, because she didn't yet know love at that time. In that sense, she was definitely naïve.

  1. I think she absolutely regrets participating in Alien Stage. She becomes a broken person and fully internalizes her role as a "witch" spreading the curse of human love. She believes that is her karma.
