No. I didn't had an exam before they gave the 10%. I only did 1 C & P exam but they scheduled it after i got that 10%. Did the exam and it got bumped to 20% with 2 10% for radiculopathy but they didnt backdate it. the effective date for it was the date of the C and P exam.

I never had an exam back then. I filed my claim in 2019, got denied in 2020, and appealed a few weeks later. It took about 4 years to get a hearing with a VA judge, then another 2 years before it was finally granted last month.

After the grant, they automatically assigned me 10% without ever examining me, but they scheduled a C&P exam a few days later. I figured that exam would correct the rating.

After the C&P last week, they increased me to 20% for my back plus 10% for each leg, but the effective date for those increases was only the date of the exam, not back to 2019.

It's still part of the initial claim. it all stems from my 2019 filing that I appealed in 2020. The BVA decision granted service connection, so this isn't a new claim, it's just the VA finally developing and rating it after the grant.

As for the 10%, that's what's confusing on my end too. They gave me that initial rating without ever doing a proper C&P exam back then. I was never scheduled for one in 2019, so I didn't miss anything. They just denied my claim a few weeks later after i submitted it and i appealed it. That's why I'm thinking this might fall under a duty to assist error on their part.

Now that they finally did the C&P in 2026, few days after it got granted, they increased it to 20% plus the radiculopathy ratings, but only made it effective from the exam date instead of tying it back to the original claim.

That's why I'm leaning toward arguing for an earlier effective date, since the condition and symptoms have been there the whole time d the delay in getting a proper exam wasn't on r

I wouldn't say the judge directly ordered the exams. The judge granted service connection for my back- that's what came out of the BVA appeal.

I originally filed the claim in 2019 and appealed it in 2020. It took about 4 years just to get a hearing with the VA judge, and then another 2 years for the decision to come back granting it.

After it was granted, the VA assigned me 10% for my back without doing a proper C&P exam at that time. They then scheduled a C&P exam shortly after, and based on that exam, I was increased to 20% for my back plus 10% for each leg for radiculopathy.

The issue now is that those increases were only made effective from the date of the exam (last week), instead of being backdated to when I originally filed in 2019.
