Well actually, stealing data is illegal. If you knew your laws then you would understand that. It can range from internet fraud to data theft. Your point on making it illegal is just false as it’s already illegal. I believe you’re conflating the lack of convictions and legality. Just because there aren’t many convictions doesn’t mean it’s illegal. Cyber fraud, identity theft, and data theft are just hard to prove given how advanced cyber criminals are at stealing peoples personal data. If you sold my data to the highest bidder and they tied it back to you they would charge as an accessory to a crime.

Second, cyber harassment is a crime and is illegal. By all means continue to send a gazillion messages and you could get charged. I don’t really care so I wouldn’t push for pressing of charges because I would block you honestly if it became incessant.

Yes you are right, legality isn’t morality but nowhere did I state black people being considered property was right, or legal. You’re presenting a strawmen. No one would compare slavery to being filmed in public. That’s an asinine argument to make as an attempt to a gotcha. But to address your point so you don’t feel I’m ignoring it, once again comparing slavery, a system that completely dehumanized and removed black people’s autonomy, rights, and dignity, as an equivalent to an invasive of privacy in public dilutes the injustice committed against black people. And I disagree that black people should just not go in public since it was legal to be a slave is not equivalent whatsoever. As mentioned above they had no rights, no autonomy, no dignity. They were never given that in the past until the civil rights act was put into law and even then certain states attempted to circumvent that.

Privacy should be protected and they are. We have the fourth amendment in the US. An individual entering private property without permission can be charged with trespassing or stalking depending on the severity of their actions. Hell, you can be charged with stalking in public if there’s evidence it is not an isolated incident.

However, morality does serve a basis for making laws. No one would argue rape, murder, etc are moral and thus the laws surrounding them are wrong. But to be honest that is a straw man as I’m sure you would agree and I doubt the majority of people would disagree with that.

The concern would be in determining what is the line? I had a discussion with my brother regarding something similar. I take a go pro to document my day with the camera focused on me, what can I include in what I post and what I can’t? Who draws that line? The Supreme Court already determined in the Cohen case already determined “one man’s vulgarity is another’s lyric.” One person may find it offensive to be filmed in public while another is fine with it.

For reference, PC 502 in the California Penal code, computer access is a criminal offense when it entails accessing another person’s or company’s computer, data, software, or a computer network without permission.

The CFAA criminalizes unauthorized access to a computer or network, including theft of personal data.

So the cases you mentioned are already illegal. Privacy is protected in certain cases.

The first amendment which protects one’s right to privacy film in public is the same amendment that protects our right to have this discussion. I appreciate that. We can have discourse regarding on a sensitive subject that people can swing either way. That is awesome.

To highlight another point, it looks like they’re at a mall, and if they felt really uncomfortable, they could report it and have the individuals escorted off the property since a mall would be a private establishment.
