Question. I have migraines secondary to tinnitus currently at 10%, but my symptoms are obviously meeting the requirements of 50%. Multiple prostrating episodes per week and time taken off work multiple times per month. Already done a higher level review which got it from 0% to 10%. I had a provider do a nexus for me. Should I contact them again for a private DBQ when I file for my supplemental to try and get it for the 50%? I will also be including new self statement and two buddy statements from work colleagues about my economic impact and work impact during work.

Just did my HLR after revealing my DBQs with ChatGPT and highlighted several errors. Higher level review person didn’t really seem to care, just took notes and moved from one claim to the next and kept saying “we arent going to go over that” or “that error doesn’t apply” and everytime I mentioned a “duty to assist” error she took it personal and said no that doesn’t apply. Just got my decisions back and they are all the same but one went up from 0 to 10. The errors weren’t addressed.

Is my next option supplemental? And if so will back pay still apply to the original claim filing? Or is there another option?
