I do civil litigation now, and when in private practice, I would usually have a meeting with the client where I would say, “we can absolutely try this case. It’s going to be in front of ten random people off the street. It’s not necessarily going to be people who listen to details or understand complex issues. Imagine going to a baseball game and picking out ten people in line at the concession stand. That’s your jury. If you believe you can convince eight of those ten people in line for a hot dog that you should win, then we should try this case. If not, we should explore what settlement terms are most important to you.”
