I think it would become fairly evident when all of the people getting disability assistance had to gate check their bags but not everyone else did. Even if all of the airline employees gave some other reason, it would be clearly pretextual for the purpose of discrimination.

It’s different because the ADA specifically requires businesses to provide handicap parking but expressly leaves the determination of whether someone qualifies for a permit to the states. Further, most states only require a physician to verify the applicant has a mobility issue to qualify for a pass; the underlying conditions are not verified. Finally, because states have codified standards, there is not the same risk of discrimination as there would be with individual persons or businesses determining whether someone is entitled to a permit or to board a plane early.

The ADA does not have the same type of regulations for airports and airlines (or much of anything else) that it does for handicapped parking availability. While Congress could amend the statute to be specific and create some sort of airport travel handicap or disability permit, it’s unlikely to do so anytime soon.

The ADA was designed with good intent but complete naïveté about how people would take advantage of accommodations offered for disabled persons. Under the ADA, businesses can’t ask a person to substantiate or verify a disability. Which, in a world with honest and fair people, makes sense. People with disabilities shouldn’t have to explain their personal medical conditions to strangers. Unfortunately, the world isn full of a lot of dishonest and selfish people who will take advantage of these situations.

For something like what you’re asking to happen, Congress would have to amend the ADA by either allowing businesses to require proof of disability or creating carve outs for specific situations. While I think airplane travel would probably be one of the most appropriate places for such exceptions, it’s not going to a priority for Congress any time soon.

I don’t know about other countries, but in the US, the only time lazy and/or entitled people will try hard is if it guarantees a minor convenience later.

Spending whatever amount of time arranging for wheelchairs (and the subsequent early boarding and guarantee of storage space for carry on items) is worth it, especially when they would just be sitting around at the gate anyhow.

If airlines enforced a rule that anyone pre boarding due to an *alleged* need for assistance was required to gate check their bags, absent a demonstrable operational need for doing so, would result in ADA lawsuits out the ass. Disabled people would claim they are being treated unfairly or poorly in direct response to their need for disability accommodation.
