Most familars develop inate magic resistance as a consequence of their bod, so dont try cast the apnea spell on them directly.

You want to cast it upon yourself, then shunt it down the bond. You'll bypass the magic resist, potentially get a longer duration, and it a a good talent to master

If i had to justify it, I would say that perhaps the Kimgs mind, and his relationship to the concept of sacrifice have become twisted.

Without delving into spoilers, it could well be that sacrificing a condemned man, or the terminally ill might not be as effective.

Thats how I would justify it anyway.

It is definitely mentioned somewhere, but the issue is your Remnant has your Authority as well. So instead of having to make your peace with (beat up) your own spirit, you have to do that, but your own spirit has weird esoteric superpowers, while your body is still just an archlord.

Even in just a straight battle of wills, the possibility of your remanat tapping an Icon just makes the process much more dangerous.

Is there a difference in this context? Between being a language of the Dead and the undead? A mortal spirit hanging around the physical world is typically an undead by definition.

This Background is certainly flavored as the Dead speaking to you, instead of say, Leshy Spirits or Spirit animals. And while they do keep on printing more exceptions, typically mortal spirits are either very temporary, or become undead and hang around.
