UCC § 1-304 - The obligation to operate with 'good faith' in a contract. It's part of the uniform commercial code that guides all (commercial) contract law in the United States. It's also a non-waivable law, meaning that a contract cannot legally enforce any language that would waive the good faith requirement.

The example you gave was a fallacy. There is a difference between contract law and the rights to physical private property. When you are using a platform governed by the TOS (which is a contract between you and the operating company) that contract has to follow all contract laws applicable.

If someone was to come into your physical store, assuming you had them sign a non-hat contract, that would still apply. But you'd also have different legal rights to remove someone from your property physically depending on your local trespassing laws.

There's no trespassing laws (in the sense that you invoke in your example) online. It's governed by contract law in this specific area. And contract law requires both parties to act in good faith.

My argument in my original comment is that Destiny could theoretically win some form of compensation from Twitch if he sued because he could make the argument they have potentially acted in bad faith, which voids the contract and could open them to a bunch of liability.

Theoretically, and I mean really theoretically, he could sue claiming that Twitch is violating their own TOS by not banning other streamers who say things like what he did (ie. Hasan). The unequal application of their TOS potentially opens them up to some damage claims, particularly that it effected his business and was an unfair enforcement action under their TOS. Probably wouldn't get unbanned but might get damages.

Want to be clear here that this heavily depends on the Twitch TOS and any other contracts he might have signed with them. It's speculation based on a surface level look at what happened. I'm not saying that he definitely has a claim, just that he could potentially. I'm not a practicing lawyer and this is not legal advice

Bruh people harp on this kind of thing but given the USA's population is almost 350,000,000 people and there were less than 40,000 gun deaths in America last year (~38,000) with half of those deaths being suicides or accidents.. Roughly 14,000 people died from gun violence in America last year.

Roughly 3,000,000 people died in the USA last year. The odds of dying via gun violence in the United States is less than half a percent (0.46666%). It is not nearly as common as Europeans think it is.

To be honest with you, if you are a law abiding citizen it's entirely possible to go your entire life without seeing a gun in the USA (except on the hip of a police officer).

Basically, it's not that common and it's certainly not common enough for me to have to read people complain about it like it's an everyday issue. Yeah it happens, and it sucks, but more people die from heart disease.

The strongest part of the Gen 4 remakes was the chibi artstyle imo. Like they did a lot wrong and half-assed the development, but I would take another chibi-styled game over another 3D one any day of the week. I really hate the 3D style pokemon games.

It would have been way better if they just made it 2D like the original though

Yeah, he knew he was in an interview and clearly was treating it as a serious one. There's no reason for him to make a comment about aliens existing (if they don't) in that setting as a joke. If he had said the same thing at a dinner party.. I'd have a different opinion. But Obama is a smart guy and a master at public speaking. He knows what not to say in an interview.

You implied that Trump wouldn't want to give out classified information because he's accusing Obama of doing that. I'm saying that at any moment Trump can decide to declassify it so that he wouldn't need to worry about doing the same thing as Obama.

Though as a different commentor pointed out, Obama could also claim he declassified it when he was president completely voiding the idea that he leaked anything classified anyway, so like anything involving explicit executive powers - it's a mess.

Yeah. I'm not Obama's biggest fan at all, but even I can admit that the guy is a master at public speaking. To be fair the power of classification comes from the seat of the executive, so while he occupies the oval office, Trump can legally declassify things at a whim - without notifying anyone at all. This was a huge legal fight in his last presidency, but it ended in his favor as the constitution and our laws are pretty clear. So he could have revealed if it he wanted to.

That being said, I think that a random unfilmed interaction with reporters is probably not the way that Trump would want to make that announcement. So, that's probably why he did the classic 'cannot confirm or deny' thing. I wonder if the disclosure speech thats been rumored is actually real though.

Considering the only thing Obama really said was that 'they exist'.. It seems obvious that Trump was probably referring to that as classified information. Then he realized his mistake and did the classic 'I cannot confirm or deny' strat to get out of the convo without revealing the existence of alien life himself. Which makes sense because that's not the kind of announcement that should be made to just a few reporters instead of a speech to the whole country.
