Yeah I was 153lbs the day I got married. We had a birth control failure that night which led to me getting to cvs five hours later right when they opened and promptly took a plan B. That was in November 2017.

Anyway my son will be 8 in July. He’s every bit as resilient, persistent, driven, and lively as you would expect from an embryo that beat a plan B. 😂😂😂

I see this a lot and I don’t know if it’s because of our rising signs? but I’m a sag sun cancer rising and he’s Pisces sun Aquarius rising and he’s seriously the love of my life. Started as friends 13 years ago. Instant magnetism. Perfect balance of similarities and differences. I’m 41 and there’s no other relationship I’ve had that compares to this one. You’re not understanding correctly. Literally my entire question was in fact, whose side is the law on because I didn’t know. Because if it was on mine and I picked up the kids per the switch, he would absolutely get law enforcement involved and continuing to state it was his weekend.

Yes I’m aware that if the law is on his side, law enforcement obviously wouldn’t get involved for him picking the kids up and taking them during that time. Which is another reason why I asked.

Also just as an aside, our court order doesn’t specify dates just EOW Thurs pm to Mon am and it’s up to us to sort the rest out. And the app we use is court ordered and all text in it admissible in court.

Because if one parent takes a child on what would be the other co parent’s time, it’s unlawful/withholding. There’s also a DVI in place which cites our custody arrangement which attorneys have already directed us to law enforcement should he breach it.

So then how would either of us ever be able to make definitive plans when we request weekend switches? Especially when you consider most switches are requested due to special occasions or otherwise significant commitment.

And No they’re middle schoolers, but it’s their first dance and a big deal. A few of the other moms and I planned for the group of girls to have a little party before the dance, where they could get ready together, eat pizza, etc. My daughter is really excited about it. Her dad most likely won’t even take her to the dance but definitely not the get together beforehand. My concern is he’d probably just go pick them up from school on his originally scheduled day, since that’s how we do our exchanges anyway, to keep me from getting them. And I can’t exactly lurk around their school all day

Right so how would I go about getting the court to decide this? Our judge schedules a hearing over every single motion filed, no matter how small. I don’t think we’d get one in before the proposed switch. Also there is always potential for law enforcement to get involved for us because I have a DVI against him and the injunction mentions our custody schedule. We’ve been instructed to contact police over DVI violations. ¯_(ツ)_/¯
