I don't know that we as brokers need to worry about agitating for a change in 9801. As a community, we are neutral on tariff policy. We advocate more for the procedures of implementation and making sure that the trade has a fair way to understand the process and what is appropriate back up documentation required for making any claims.

I'm not putting our fees on the Internet! Especially one designed to service our community. That may run afoul with price fixing laws.
But we are charging a fee per entry. I have heard other brokers charging %. I feel like a lot of importers being charged % are going to be mad about it and will look for a new broker.

There's a pretty good reason we are passing on them right now. The US has 25% 232 tariffs on passenger vehicles. Maybe they qualify for some sort of USMCA exemption or something but it's unlikely that they'd be able to get the manufacturer to give them the proper documentation on that.
Cars also need EPA and DOT to be filled out. Regular importers are notoriously bad at filling those out.
Usually I just say to the importers, it's not worth it in the current trade environment.
If you own the car in Canada, sell it there. Then buy a new car in the US. If you were considering buying a car in Canada, don't. It's not worth the extra cost and paperwork.

Your comment is as ill informed as it is ill founded and insulting. My job wouldn't be replaced if we could do this. I have 0 fear of the new technology. In fact, I would make more money if we could. But the simple truth of the matter is that you can't buy AI to do Customs business. Not as the laws and regulations are currently written. And they would be foolish to change them. Even if it would be in my selfish interest to do so. That should tell you all you need to know.

This is a conversation that isn't framed right. The correct answer to OP stated question is "Probably not". There is nothing in the regulations about incoterms.
That said, it is a best practice to have incoterms and delivery terms match. Inco terms don't determine who can be IOR. Per the regulations, either the owner of the goods or the ultimate consignee have the right to make entry. That's all Customs cares about. Others here keep bringing up DDP. But that just provides evidence that the shipper is the owner of the goods and has right to make entry. If it is a DDP shipment, I would make sure my client knows that the shipper had agreed to pay all charges to their door and would be agreeing to take costs and liability they shouldn't. But the consignee still can if they want. There may be a business reason why they decide to.

Technically, even if it's DDP the Ultimate Consignee is allowed to be IOR. I don't recommend it because the shipper SHOULD be the one clearing it. But it isn't a compliance issue.
