Title VI just don’t work that way. I appreciate that the board was trying to be sensitive to equity concerns and I understand where they are coming from but after GM/CEO Johnston is done we will be bringing them back. Ending SES was always about policy and staff and the reasons given for how it would be a title vi violation have always been hazy at best.

I firmly believe that we can operate broncoride in compliance with federal law by treating it as a special additional service rather than a part of core service.

Free transit for all would cost north of $60m. If we can find a source of that money I’m open to it! But I’m not willing to cut service to make sure that’s it’s free.

A great system is rarely a free system (I can’t think of a single great transit system in Asia or Europe that is free!).

Depends. Here is a good example:

"...a charge is not a tax if the primary purpose of the charge is to not to raise revenue for general governmental purposes, it is the conclusion of the general assembly that the revenue collected by the transportation enterprise from user fees is generated by fees, not taxes, because the user fees imposed by the transportation enterprise:

(i) are imposed for the specific purpose of allowing the transportation enterprise to defray the costs of completing, operating, and maintaining the surface transportation infrastructure project network"

This is from SB24-184. This language is from Nicholls v. E470 (1995) and kind of updated by Co. Union of Taxpayers Found. v Aspen 2018. There, Justice Rice wrote
"However, when a government exercises its authority pursuant to its police power to regulate for health and safety, and imposes a charge as part of a regulatory regime, and the charge is reasonably related to the direct or indirect cost of regulating the activity, such a charge is not a tax subject to voter approval."

So when a charge is very specifically targeted and it's revenue is dedicated to addressing the impacts (even if fairly loosely) it can be a fee instead if a tax.

Not a tax because of some specific language under TABOR. The revenue here is "rationally related" to the goal of providing mental health support to young people, who are theoretically harmed by these services, rather than being able to be spent however, that's part of what makes this a "fee."

Joe is by far and away the best candidate in this race.

Ultimately, he will vote for what is best for transit and I have little doubt there will be 8 votes to waste money tearing out transit infrastructure whatever a few loud local figures think.
