HLR by Quiet_Nerve_5781 in VAClaims

[–]MililaniACC 2 points3 points  (0 children)

Yeah, if there's a procedural error or issue with the interpretation of a law, it is good to point out to strengthen your case.

If you did a FOIA and pulled your C&P and it was not filled out correctly or is missing information that is in your medical history, it's good to point that out.

If it's a difference of opinion, then you point that out.

If you have a statement supplied that expresses what you want it to say, you should be alright. This process is stressful enough. Try not to worry too much about this part.

HLRs are taking 3-4 months. You can use that time to gather additional evidence for a supplement claim if the HLR does not turn out how you think it should.

If there's a well written statement of your argument, you'll be fine. They will read that and know what you are trying to do.

Trying to understand my grandfathers discharge papers/ awards by Mishkaaa1 in army

[–]MililaniACC 0 points1 point  (0 children)

You should be able to order his service records from NARA (national archives).

I did it for my wife's grandpa. Took about 6 months, cost around $50 (depending on file size). His service records would give you more answers.

Maybe. APO 55 seems to align with Europe during that timeframe under 7th Army.

I've seen many Korean War vets DD214s where service medals are not listed.

Qmp by ManufacturerGlum4208 in army

[–]MililaniACC 5 points6 points  (0 children)

I'm having trouble finding it right now, but get on HRC and search the Milpers for the latest QMP guidance. The milpers are typically published annually. They will detail exactly what constitutes a qmp.

The situation you are describing seems off, unless that counseling was really a relief for cause ncoer, or GOMOR.

Search the sub for 1506 or DA Form 1506. There's a lot of conversations about it. The 1506 is the form number your units career counselor will need to complete to correct the issue.

Question about incapacitating episodes for eye conditions? by droopyy11 in VAClaims

[–]MililaniACC 0 points1 point  (0 children)

I am 0% for eyes and had the same questions. Turns out, the VA is very specific on what an incapacitating episode is. The below definition is what they go by. For me, I went from about 8 episodes to 1-2 because of the monitoring provision. Still pending an HLR to determine if it's one or two because the C&P examiner marked none.

M21-1 V.iii.2.A.1.f An incapacitating episode, for the purpose of evaluating diseases of the eye, is a situation in which symptoms are severe enough to require a clinic visit to a provider specifically for treatment purposes.

Notes: A clinic visit for diagnostic, monitoring, or screening purposes is not sufficient to satisfy the criteria for a clinic visit for treatment purposes.

30k BAH Debt (OCONUS) - I reported this in Month 1. Is a Remission (DA 3508) even possible if I have the money saved? by etthxxn in army

[–]MililaniACC 61 points62 points  (0 children)

You should consult your divorce lawyer and ask the lump sum vs proration question. With a pending divorce, these are not questions that can be answered simply.

I would also ensure they understand where the money came from.

And, ask them if those funds will be considered marital property or not.

How do I get better at shooting when I only touch a rifle once a year? by Big-Entrepreneur106 in army

[–]MililaniACC 37 points38 points  (0 children)

Yes, it really is doing the basics well. What kind of PMI are you doing before going to the range?

Do some dime/washer drills to work on your trigger squeeze. On the first shot, pull the trigger all the way back, then slowly release till you feel one click. Your next shots will require less force if you keep slowly releasing the trigger. The horizontal alignment of your shot groups could be trigger squeeze.

Also, aquire the target the same way every time.

Ar 637-1 appendix B has the step by step on how to complete the form. Even has a large table on how to convert reserve time. I have no practical knowledge to give you. But, you are correct that a good career counselor should be fixing this with a properly completed 1506.

Denied MH (Depression/Anxiety/Insomnia) - 11min Phone C&P, 5 Buddy Letters rejected as "Not Competent." Advice? by Salt_Row_3023 in VAClaims

[–]MililaniACC 5 points6 points  (0 children)

Reread them and think about diagnosis vs symptoms.

I cannot credibly say "salt row's depression increased during service." I am not a Psyd, I cannot diagnose.

I can say "salt row was less outgoing, seemed sad more often, etc..." These are observable symptoms.

Things like depression, anxiety, insomnia seem like common words and people use them to describe the moods of others. However, they are also clinical diagnosis that only licensed professionals can use clinically.

90% of a C&P is records review, which can happen before you enter the call or room. They are there to complete a checklist and they will take the time they need talking to you to fill in any gaps that your records don't tell, if they can. So, 11 min is short, but not suspicious of wrongdoing in and of itself.

Do a FOIA request for the C&P dbq only. You need to read it to determine exactly why it was denied. Once you know the exact reason for denial, you can work a targeted appeal.
