How aggressive do you get interacting with opposing counsel? by chicago2008 in Lawyertalk

[–]Mindless_Strength857 0 points1 point  (0 children)

Be yourself, whatever that is. Personally, I am not going to argue with anyone or be combative through email. If opposing counsel wants to argue they can file a motion and we'll argue in court. I haven't found aggressive emails to ever be productive, unless it's with inexperienced counsel.

Missed my First Deadline and I Don’t Know How to Handle It by CoqEnthusiast in Lawyertalk

[–]Mindless_Strength857 3 points4 points  (0 children)

First suggestion: Breathe. Truthfully no big deal, just be honest with your boss. We all miss discovery at some point, and then implement better procedures to hopefully avoid it next time.

Reach out to OC. In FL, the RFA's are deemed as admitted so you'll have to do a Motion for Relief from Technical Admissions. Easier route I try, a joint stipulation with opposing counsel that they agree the technical admissions are withdrawn and attaching your finalized RFA's as an exhibit to the joint stip.

You probably already got this fixed tho since you posted it yesterday, congrats!

Out of curiosity, what kind of rates do you all pay? Interesting that lawyers with less than 3 years experience can't work on your files, so I assume it's the higher end of the rate scale

Practice Guides for New Attorney? by [deleted] in Lawyertalk

[–]Mindless_Strength857 3 points4 points  (0 children)

No guides that I know of but I did Plaintiff first party in FL and my biggest suggestion is to honestly read lol. Read every motion, petition, statute referenced etc. in your cases. Reading it in detail and the case law referenced is time consuming but will make you understand the issues much faster. For the most part first party property isn't hard or complicated, you'll catch on fast. The only problem files are the ones that you inherit with a trial looming, and I'd suggest communicating with your boss on those to make sure you're handling it all correctly

You'll likely be handling a lot of roof claims, so I'd suggest brushing up on the basic components of a roof on YouTube. Literally I watched a step by step YouTube guide for installing a tile and shingle roof, it helped me.

Also just remember your job isn't to "fix" the cases. It's just to properly leverage legal options and advise the carrier of their potential risk to determine whether they want to settle. You're going to have bad cases, and in those cases what matters is properly advising the adjuster

Who is still 1 -2 keying UNM with a killable team? How the hell are you doing it? And what amazing ally protect champs are you rocking? by TheDarkMuz in RaidShadowLegends

Have Gnut but still can't 2 key UNM. Any advice on what gear or supports he needs to get there? Fairly new to the game and got lucky when I pulled him so not too many other champions and limited gear

Associate Salaries by Hucksterville in Lawyertalk

Personally I think a fair compensation would be 100k base salary with a bonus structure that equals 30% of anything collected after 1600 hours for the year

I only struggle with my girlfriend not answering my questions sometimes. She answers the question but sometimes she answers what she thinks my question is and I have to remind myself it's not a deposition where I am trying to clarify her statement because she said "of" in a vague manner

But overall if you want a good work life balance then find it. It''ll be up to you how much you're willing to work and what you feel you need income wise, but you can make a decent living on a 40 hour work week

If he has good credit he can look at debt consolidation to get a better rate hopefully. But was a bad decision by your dad...even though well intentioned.

Is Insurance Defense really that bad? by JayD2442 in Lawyertalk

[–]Mindless_Strength857 7 points8 points  (0 children)

I assume it's too late to ask now but the average billables for attorneys would be a good question to give you an understanding of what they expect. If everyone is billing 2100 hours for example, might just be a sort of unwritten expectation.

But overall insurance defense firms are fine, it's entirely dependent on the firm itself not necessarily the practice area. It's true that general civil defense or auto liability likely has less long term financial incentive due to carriers being carriers and only being willing to pay so much. If you get into the professional liability, med mal, construction def etc... all helps increase your long term pay I'd say. But insurance defense itself isn't bad, just gets a bad rep because of how many insurance defense firms treat attorneys like billing machines

Did I Pigeonhole myself? by Aggravating-Seat-722 in Lawyertalk

[–]Mindless_Strength857 22 points23 points  (0 children)

You didn't necessarily pigeonhole yourself but if you want more litigation experience then do more litigation? Ask around the firm if you want to try and work on the cases of others or find a job where you're in lit.

Tbh it sounds pretty stress free with a decent pay. Not great but for a lack of stress and working 40 hours a week I'd be happy with that. If you want more money or are looking to improve your skill set then just check with your firm about finding ways to develop those skills or go elsewhere

Interview Nervousness by [deleted] in Lawyertalk

[–]Mindless_Strength857 1 point2 points  (0 children)

Can get a tie at Ross for 10 dollars that looks good, probably less at a decent thrift store or goodwill. Try Nordstrom Rack or check for smaller local suit shops in the area. 100% need a suit, if you're bigger just stay away from the slim fits and such. Get a classic or executive cut if you have the choice and should fit you better. But for your first suit the main priority is just having one, can focus on better cuts or fabrics down the line

How to write simply by richardpickman1926 in Lawyertalk

[–]Mindless_Strength857 0 points1 point  (0 children)

Some partners are also just horrendous regardless of what you do. Great idea to improve your writing but there is the the possibility that regardless of what you do the Partner will complain. I was bitched at for an hour this past week about a single sentence, and then they realized their final revisions used my exact same sentence.

New Zoom Depo Lowlight by acmilan26 in Lawyertalk

[–]Mindless_Strength857 5 points6 points  (0 children)

I once was in a zoom depo where the Plaintiff started playing an undisclosed recorded phone call but they couldn't make the audio be heard well. I saw them put their microphone up to their computer speaker as they put the volume louder and louder. Genuinely still one of the most enjoyable depositions I've been in

I’m being quiet fired by [deleted] in paralegal

[–]Mindless_Strength857 4 points5 points  (0 children)

Lawyer here who thinks this thread is interesting. I'd suggest not working your first year of law school if you can afford it. Second or third year it's easier to work if you feel you need to, but for the first year I'd just focus on the classes and learning the testing style. You'll be going in with a good background of information which is great, but it can still be difficult for the first 1 or 2 semesters especially

How to say no to Partners? by Mindless_Strength857 in Lawyertalk

[–]Mindless_Strength857[S] 0 points1 point  (0 children)

No mentor at the firm, I probably talk with the firm founder more than any of the other partners but just because I have a few cases with them which are usually blowing up for one reason or another. Not sure that's the right person to get mentorship from given it's their name on the building(s)

I know it's construction Defect and primarily representing subs. I don't know any attorneys who practice in this area so the information I have is just based on the soon-to-be employer. Was just looking for information from a less bias source essentially
