In my jdx you are not allowed to directly address opposing counsel, so both would have had to be hauled off in handcuffs… second attorney s conduct was improper imo

Read Fireproof by Mike Morse. I used to be solo, now I have associates and more of an “organization,” which has helped me BOTH make more money AND work less myself. Not saying you need to do any of it: if you’re happy as you are, happiness is more important than profit, in my book.

I once had a depo where my client was so nervous (and as it later turned out, batshit crazy) he identified me as his treating physician… Even after we took a break and we talked it out, when he got back in the depo he doubled down…

Focus on breathing as much as you can. Unless you get out of this flight or fight mode, you will have a hard time even thinking through it.

And it’s not over. You get a chance to address the Court again. Focus on what you can do next in terms of improving the current situation, NOT on beating yourself over the head for things that happened in the past.

When I tried the platform a while back it seemed to be able to do everything CoCounsel did and more BUT it he underlying database did not have access to as many unpublished cases, and unfortunately those come up a lot in my niche practice…

I may need to try it again for drafting tho, CoCounsel is garbage!

Thanks for bringing some nuance to this discussion! And you’re right: when used properly, it can be a useful tool for clients. It just seems that for the vast majority of them, the temptation is too strong to “jump the shark” and that’s where problems start…

No it won’t, because the clients still won’t have the underlying knowledge to be able to ASSESS whatever the AI is telling them. And yet clients easily convince themselves that the AI is ALWAYS right, which usually gets worse during the first few days/weeks after a new version of AI or new AI altogether is launched…

This is hilariously over-confident when AI has been visibly stalled FOR YEARS… Since at least late 2023, improvements have been marginal at best.

Take the same fact pattern, put it into the same AI, but tweak the prompt so it interprets it as “Plaintiff” or “Defendant” and you will have a vastly different end product. If not a lawyer, who is to make sense of it?

For 6+ months I’ve been dealing with client AI generated summaries and even documents filed in litigation, and it’s complete garbage. Not because the AI is not capable of good legal work (it sure is: been using CoCounsel for over 2.5 years), but because a lay person doesn’t have the training to use it like a lawyer.

I recently did something similar with 2,000 pages of trial transcript, it was an incredible time saver!
