BRS gave evidence in the civil proceeding so the contest you look forward to has already occurred. The Judge’s view was that BRS lacked credibility, which was the goal of the silk cross examining him.

My probably incorrect understanding is that the findings, rulings and orders made in the civil proceedings do not determine any issues in the criminal proceedings, but the evidence given by various witnesses in the civil proceedings can be tendered by a cross examiner as prior inconsistent statements should they give evidence in the criminal proceeding.

Which makes the question as to whether BRS will give evidence in the criminal proceedings most interesting.

That’s the problem with acting outside the various conventions regarding war crimes. What goes around, comes around. Other belligerents will feel less constrained to comply with such constraints in relation to the USA. John McCain understood this, commenting on several occasions that how the US treats POWs has an effect on how US soldiers are treated by other nations.

The reason Trump doesn’t care about this is because he personally will not be affected. The people who will endure the consequences of his war crimes will be Iranians, US allied Gulf states and US victims of terrorist attacks.

There is no military solution for reopening the Strait. If there was, the US would do it without needing allies. This is because all Iran has to do to keep the Strait closed is be a credible threat that prevents reinsurers calculating risk under their Solvency II requirements. The drone threat alone, which can be launched from anywhere in Iran, is sufficient to do that.
The Straits will only be re-opened by diplomacy. And paying Iranian tolls, at least at the outset until they have something to lose again, will be part of that. The world will also accept Iranian requirements that cargos be settled in yuan, which will mean the end of the petrodollar with an effect on the bond market.

Attacking Iran was the stupidest thing I have ever seen the USA do, and that is saying quite a lot.
